HomeMy WebLinkAbout12301 ORD - 10/09/1974•RWC:jkh:hb:9 124/74: • let AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF SEYMOUR MENDELL BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 3 -ACRE TRACT OF LAND OUT OF LOTS 17 b 18, SECTION 28, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM 11-11111 ONE FAMILY DWELLING DISTRICT TO "R -2" MULTIPLE DWELLING DISTRICT AND CHANGING THE ZONING ON A 7 -ACRE TRACT OF LAND OUT OF LOTS 17 & 18, SECTION 28, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM R-2 MULTIPLE DWELLING DISTRICT TO A -1 APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL ._ OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE - WITH. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF SEYMOUR MENDELL FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLI -Cj SAID PUBLIC HEARING HAVING BEEN HELD ON Wednesday .Tune 19, 1974 , AT SpeCiel COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS - CITIZENS: NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE No. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. 12301 • • SECTION 2. That the zoning of a 3 -acre tract of land out of Lots 17 6 18, Section 28, Flour Bluff and Encinal Farm and Garden Tracts situated in the City of Corpus Christi, Nueces County, Texas, more particularly described as follows, be and the same is hereby changed from "R -1B" one family dwelling district to "R -2" multiple dwelling district: BEING 3.0 acres of land, more or less, out of Lots 17 and 18, Flour Bluff and Encival Farm and Garden Tracts as shown by a map recorded in Volume A, Page 43, Map Recoads of Nueces County, Texas: BEGINNING at the West corner of Lot 2, Block 2, Greenway Gardens Unit 1 as shown by a map recorded in Volume 38, Pages 1 land 2, Map Records of Nueces County, Texas for the North corner lof this tract, said West corner being on the Southeast boundary line of Lot 9, Block 2, Greenway Gardens Unit 2 as shown by a map recorded in Volume 38, Page 3, Map Records of Nueces County, Texas; THENCE with the Northeast boundary line of this tract, the following courses and distances: South 10 °00'00" West 115 feet, more or less; South 28 °00100" East 115 feet, more or less; South 53 °00100" East 230 feet, more or less; and South 61 °00'00" East 170 feet, more or less for the East corner of this tract; THENCE with the Southeast boundary line of this tract, South 29 °00100" West 145 feet, more or less, for the South corner of this tract; THENCE with the Southwest boundary line of this tract, the following courses and distances: North 61 °00'00" West 280 feet, more or less; South 83 °00'00" West 100 feet, more or less; and North 61 °00100" West 170 feet, more or less, for the West corner of this tract; THENCE North 29 °00'00" East at 60 feet, more or less, pass the South corner of said Lot 9, Block 2, and continuing along the Southeast boundary line of said Lot 9, Block 2, in all a distance of 424 feet, more or less, to the POINT OF BEGINNING; and that the zoning of a 7 -acre tract of land out of Lots 17 and 18, Section 28, Flour Bluff and Encinal Farm and Garden Tracts, more par- ticularly described as follows, be and the same is hereby changed from "R -2" multiple dwelling district to "A -1" apartment house district: Being 7.0 acres of land, more or less out of Lots 17 and 18, Section 28, Flour Bluff and Encinal Farm and Garden Tracts as shown by a map recorded in Volume A, Page 43, Map Records of Nueces County, Texas: -2- BEGINNING at a point on the Southeast right -of -way line of Rodd Field Road for the West corner of Lot 9, Block 2, Greenway Gardens Unit 2 as shown by a map recorded in Volume 38, Page 3, k1ap Records of Nueces County, Texas and the North corner of this tract; THENCE South 61 °00'00" East, along the Southwest boundary line of said Lot 9, Black 2, 319.44 feet for the South corner of said Lot 9, Block 2 and a corner of this tract; THENCE South 29 °00'00" West 60 feet, more or less, for an inside corner of this tract; THENCE with the Northeast boundary line of this tract, the following courses And distances: South 61 °00'00" East 170 feet, more or less;" North 83 °00'00" Fast 100 feet, more or less; and South 61 °00'00" East 280 feet, more or less, for the East corner of this tract; THENCE South 29 °00'00" West 380.00 feet, more or less, to a point on the common boundary line of Lots 18 and 31, of said Section 28 for the South corner of this tract; THENCE North 61 °00'00" West, along said commou boundary line of Lots 18 and 31 and continuing North 61 °00100" West,along the common boundary line of Lots 17 and 32, 860 feet, more or less, to a point on the southeast right -of -way line of Rodd Field Road for the West- corner of this tract; THENCE North 28 °57130" East, parallel to the centerline of Rodd Field ,Road, 35.7 feet, more or less, to the POINT OF BEGINNING. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED.
