AND WIFE, VIOLA LANGSHAW, OF A UTILITY EASEMENT FOR JACKSON TERRACE SANITARY SEWER PROJECT, NO. 250 -70 -80.6; APPROPRIATING OUT OF THE NO. 250 SANITARY SEWER BOND FUND $185 FOR ACQUISITION OF THE AFORESAID UTILITY EASEMENT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That authorization is hereby given for acceptance by the City of Corpus Christi from Leal V. Langshaw, Sr. and wife, Viola Langshaw, of the following described utility easement for the Jackson Terrace Sanitary Sewer Project, No. 250 - 7040:6: Being a strip of land for utility easement out of Lot 4, Shell Road Poultry Acres, as recorded in Volume 5, Page 40, Map Records, Nueces County, Texas, and out of that certain tract of land conveyed to Leal V. Langshaw by Herman A. Lee recorded in Volume 785, Page 238, Deed Records, Nueces County, Texas, said strip of land being more particularly described by metes and bounds as follows: Beginning at a point which bears N. 359 24' 20" E. a distance of 10.0 feet from the most westerly corner of Lot 4, Shell Road Poultry Acres, said point being the most northerly corner of a utility easement conveyed to the City of Corpus Christi, Texas, by Leal V. Langshaw, et ux, as recorded in Vol. 1458 Page 311, Nueces County, Texas, Deed Records, for the most westerly and beginning corner of the tract of land herein described; thence continue N. 35° 24' 20" E. a distance of 185.67 feet along the northwest boundary line of said Lot 4 to a point in the south right -of -way line of Interstate Highway No. 37; Thence S. 60° 36' 10" E. a distance of 10.05 feet along the south right- of-way line of said Interstate Highway No. 37 to a point for the most easterly corner of the herein described tract; Thence S. 35° 24' 20" W. a distance of 186.98 feet along a line that is 10 feet east of and parallel to the most westerly boundary line of said Lot 4 to a point in the most northerly line of the aforementioned utility ease- ment for the most southerly corner of the herein described tract; Thence N. 53° 06' W. a distance of 10.0 feet along the most northerly line of said utility easement to the place of beginning and containing 1861.78 square feet more or less. Together with a 30 -foot wide temporary construction ease- ment northeast of and adjacent to the above described 12319 utility easement, to expire one year from date of execution of the said utility easement. SECTION 2. There is hereby appropriated out of the No. 250 Sanitary Sewer bond Fund the sum of $185 for acquisition of the aforesaid utility easement. SECTION 3. The necessity to appropriate the sums hereinabove described and authorizing the acceptance by the City of Corpus Christi of the described utility easement for the Jackson Terrace Sanitary Sewer Project in order that the project may continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the lal day of October, 1974.
