HomeMy WebLinkAbout12335 ORD - 10/23/1974JRR:VMR:10- 22- 7, 4;1ST AN ORDINANCE AMENDING ORDINANCE NO. 11025, WHICH AUTHORIZED THE LEVY AND COLLECTION OF THE 3% HOTEL -MOTEL TAX, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 9, 1972, BY AMENDING SECTION 4, REPORTS, SO AS TO PROVIDE FOR QUARTERLY REPORTS AND COLLECTIONS RATHER THAN THE PRESENT MONTHLY PROVISION, AND DELETING THE REFERENCES TO "TAX ASSESSOR AND COL- LECTOR" IN SAID SECTION 4 AND DESIGNATING THE "COL- LECTION SECTION OF THE FINANCE DEPARTMENT" IN LIEU THEREOF, ALL AS MORE FULLY SET FORTH HEREINAFTER; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE NO. 11025, WHICH AUTHORIZED THE LEVY AND COLLECTION OF THE 3% HOTEL -MOTEL TAX, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 9, 1972, BE AND THE SAME IS HEREBY AMENDED BY AMENDING SECTION 4, REPORTS, SO AS TO PROVIDE FOR QUARTERLY REPORTS AND COLLECTIONS RATHER THAN THE PRESENT MONTHLY PROVISION, AND DELETING ALL REFERENCE TO "TAX ASSESSOR AND COLLECTOR" AND SUBSTITUTING THEREFORE THE "COLLECTION SECTION OF THE FINANCE DEPARTMENT ", SAID SECTION 4 TO HEREAFTER READ AS FOLLOWS: "SECTION 4. REPORTS. ON OR BEFORE THE LAST DAY OF THE MONTH FOLLOWING EACH QUARTERLY PERIOD, EVERY PERSON REQUIRED IN SECTION 3 HEREOF TO COLLECT THE TAX IMPOSED HEREIN SHALL FILE A REPORT WITH THE COLLECTION SECTION OF THE FINANCE DEPARTMENT SHOWING THE CONSIDERATION PAID FOR ALL ROOM OR SLEEPING SPACE OCCUPANCIES IN THE PROCEDING QUARTERLY PERIOD, THE AMOUNT OF TAX COLLECTED ON SUCH OCCUPANCIES, AND ANY OTHER INFORMATION AS THE COLLECTION SECTION OF THE FINANCE DEPARTMENT MAY REASONABLY REQUIRE, WHICH REPORT SHALL BE IN WRITING. SUCH PERSONS SHALL PAY THE TAX DUE ON SUCH OCCUPANCIES AT THE T:I.ME OF FILING OF SUCH REPORT." SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID OR UNCONSTITUTIONAL BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION IT SHALL NOT AFFECT ANY OTHER SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE, FOR IT IS THE DEFINITE INTENT OF THIS 12335 CITY COUNCIL THAT EVERY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, . PHRASE, WORD, OR PROVISION HEREOF BE GIVEN FULL FORCE AND EFFECT FOR ITS PURPOSE. SECTION 3. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 4. THE NECESSITY TO IMMEDIATELY AMEND THE PROVISIONS FOR LEVYING AND COLLECTING OF THE 3% HOTEL -MOTEL TAX AS HEREINASOVE PROVIDED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT 15 ACCORDINGLY SO ORDAINED, THIS THE_92u— DAY of OCTOBER, 197+. CITY "6tl • Corpus Christi, Texas azyy of 19__y TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
