AN ORDINANCE
AMENDING THE CITY BUDGET; AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT WITH MAVERICK CONSTRUCTION COMPANY FOR
THE CONSTRUCTION OF CORPUS CHRISTI GARDEN CENTER 1974
IMPROVEMENTS; APPROPRIATING OUT OF NO. Ill TRUST FUND,
ACCOUNT 1755, $9,250, OF WHICH $8,083.84 IS FOR THE CON-
STRUCTION CONTRACT AND $1,166.16 IS FOR CONTINGENCIES
AND INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED
TO EXECUTE A CONTRACT WITH MAVERICK CONSTRUCTION COMPANY FOR THE CON-
STRUCTION OF CORPUS CHRISTI GARDEN CENTER 1974 IMPROVEMENTS, ALL AS IS
MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS
ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH 'ARE MADE A PART
HEREOF BY REFERENCE AND ACCORDING TO THE BID OF MAVERICK CONSTRUCTION
COMPANY, OPENED ON THE 16TH DAY OF OCTOBER, 1974, SAID BID BEING THE
LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI.
SECTION 2. THAT THERE IS HEREBY APPROPRIATED OUT OF THE NO. 111
TRUST FUND, ACCOUNT 1755, THE SUM OF $9,250, OF WHICH $8,083.84 IS FOR THE
CONSTRUCTION CONTRACT AND $1,166.16 IS FOR CONTINGENCIES AND INCIDENTAL
EXPENSES.
SECTION 3. AMENDMENT OF THE CITY BUDGET TO ACCOMPLISH THE PURPOSE
OF THIS ORDINANCE IS NECESSITATED FOR EMERGENCY EXPENDITURE IN GRAVE PUBLIC
NECESSITY TO MEET UNUSUAL AND UNFORESEEN CONDITIONS, WHICH COULD NOT, BY
REASONABLE DILIGENT THOUGHT AND ATTENTION OF THE GOVERNMENT OF THE CITY
OF CORPUS CHRISTI, HAVE BEEN INCLUDED IN THE CURRENT, ORIGINAL BUDGET OF
THE CITY.
SECTION 4. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE
AFORESAID CONTRACT AND TO APPROPRIATE THE SUMS HEREINABOVE SET OUT AT THE
EARLIEST PRACTICABLE DATE 50 THAT CONSTRUCTION MAY BE COMMENCED WITHOUT
DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH

ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY
TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND
THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFF�EECTT AF.ROOMMMAND
AFTER ITS PASSAG'E, IT IS ACCORDINGLY SO ORDAINED, THIS THE CC, DAY

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
