PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. s WHEREAS, there exists a 5 -foot utility easement in Lot 2, Block 9, Russell Mdustrial Area, as shown by plat recorded in Volume 37, page 47, Map Records of Nueces County, Texas; and WHEREAS, a portion of the aforesaid easement is not now needed by the City, nor will it within the foreseeable future be needed by the City of Corpus Christi for any purpose whatsoever; and WHEREAS, it has been determined that it is to the advantage of the City to abandon the easement hereinafter described so that the same may be used by the owners of the abutting property for other purposes and increment the value of the City's ad valorem tax rolls: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a portion of the 5 -foot utility easement located in Lot 2, Block 9, Russell Industrial Area, in the City of Corpus Christi, Nueces County, Texas, more particularly described hereinafter, be and the same is hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property, subject to the dedication of an ' alternate easement by plat, in accordance with the laws of the State of Texas and for the service and interest of the inhabitants of the City of Corpus Christi: BEGINNING at a point in the west right -of -way line of Villa Drive, said point being the most northeasterly corner of said Lot 2, Block 9, for the POINT OF BEGINNING of this.easement. THENCE along the west right -of -way line of Villa Drive,S 170 21' 4011 W 5.29 feet to a point for a corner; THENCE S 880 15' 0019 W 298.27 feet to a point for a corner; THENCE N 010 45' 00" W 5.00 feet to a point in the north boundary of Lot 2, Block 9 for a corner; THENCE along the north boundary line of Lot 2, Block 9, N 881) 15' 00" W 300.00 feet to the POINT OF BEGINNING. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in -full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this theJ!H:___day of November, 1974.
