AN ORDINANCE
AMENDING THE BUDGET; AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT WITH MERCER -CONSTRUCTION COMPANY
FOR THE CONSTRUCTION OF THE LAGUNA SHORES LIFT
STATION AND FORCE MAIN; APPROPRIATING OUT OT THE 250
SANITARY SEWER BOND FUND $200,000, OF WHICH $156,135.36
IS FOR THE CONSTRUCTION CONTRACT AND $13,864.6+ IS FOR
ODNTINGENCIES AND INCIDENTAL EXPENSES, ALL APPLICABLE
TO PROJECT NO. 250 -72 -4; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED
TO EXECUTE A CONTRACT WITH MERCER CONSTRUCTION COMPANY FOR THE CONSTRUCTION
OF THE LAGUNA SHORES LIFT STATION AND FORCE MAIN, ALL AS MORE FULLY DESCRIBED
IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE
OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE AND
ACCORDING TO THE BID OF MERCER CONSTRUCTION COMPANY OPENED ON THE 13TH DAY
OF NOVEMBER, 1974, SAID BID OF MERCER CONSTRUCTION COMPANY BEING THE LOWEST
AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE N0. 250
SANITARY SEWER BOND FUND $200,000, OF WHICH $156,135.36 IS FOR THE CONSTRUC-
TION CONTRACT AND $13,564.64 IF FOR CONTINGENCIES AND INCIDENTAL EXPENSES,
ALL APPLICABLE TO PROJECT ND. 250 -72 -4.
SECTION 3. AMENDMENT OF THE CITY BUDGET TO ACCOMPLISH THE PURPOSE
OF THIS ORDINANCE IS NECESSITATED FOR EMERGENCY EXPENDITURE IN GRAVE PUBLIC
NECESSITY TO MEET UNUSUAL AND UNFORESEEN CONDITIONS, WHICH COULD NOT, BY
REASONABLE DILIGENT THOUGHT AND ATTENTION OF THE GOVERNMENT OF THE CITY OF
CORPUS CHRISTI, HAVE BEEN INCLUDED IN THE CURRENT, ORIGINAL BUDGET OF THE
CITY.
SECTION 4. THE NECESSITY TO EXECUTE THE AFORESAID CONTRACT AND
TO APPROPRIATE THE SUMS HEREINABOVE SET OUT AT THE EARLIEST PRACTICABLE DATE
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR

RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
IS ACCORDINGLY SO ORDAINED, THIS THE O DAY OF NOVEMBER, 1974.

from which it is proposed to be drawn, and such money is not appropriated for

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
