AN ORDINANCE
RETITLING THE FIRE AND POLICE DIVISIONS TO HERE-
AFTER BE KNOWN AS THE "FIRE DEPARTMENT' AND THE
"POLICE DEPARTMENT", RESPECTIVELY; ABOLISHING
THE DEPARTMENT OF PUBLIC SAFETY; PROVIDING
SEVERABILITY; PROVIDING FOR PUBLICATION; AND
DECLARING AN EMERGENCY.
WHEREAS, ARTICLE IV, SECTION*1, OF THE CITY CHARTER OF THE CITY
OF CORPUS CHRISTI PROVIDES THAT, WITH THE EXCEPTION OF THE FINANCE DEPARTr�
MENT AND THE LEGAL DEPARTMENT, ANY OR ALL OF THE OTHER DEPARTMENTS
ESTABLISHED BY CHARTER OR ORDINANCE MAY BE BY THE COUNCIL BY ORDINANCE
RENAMED OR CONSOLIDATED WITH OTHER DEPARTMENTS, AND
WHEREAS, ARTICLE IV, SECTION 28 OF THE CITY CHARTER OF THE CITY
OF CORPUS CHRISTI PROVIDES FOR THE DEPARTMENT OF PUBLIC SAFETY, CONSISTING
OF THE POLICE DIVISION AND THE FIRE DIVISION, AND
WHEREAS, IT IS DEEMED DESIRABLE TO RETITLE SAID DIVISIONS AND
ABOLISH THE DEPARTMENT OF PUBLIC SAFETY IN ACCORDANCE WITH THE AUTHORITY
GRANTED IN ARTICLE IV, SECTION 1 OF THE CHARTER OF THE CITY OF CORPUS
CHRISTI.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THE "POLICE DIVISION" SHALL HEREAFTER BE KNOWN AS THE
"POLICE DEPARTMENT" AND ALL REFERENCES TO "POLICE DIVISION" IN THE CITY
CHARTER OF THE CITY OF CORPUS CHRISTI, THE CITY CODE OF THE CITY OF CORPUS
CHRISTI, AND OTHER ORDINANCES OF THE CITY OF CORPUS CHRISTI SHALL BE CONSTRUED
TO MEAN "POLICE DEPARTMENT ".
SECTION 2. THE "FIRE DIVISION" SHALL HEREAFTER BE KNOWN AS THE
7FIRE DEPARTMENTS3 AND ALL REFERENCES TO "FIRE DIVISION" IN THE CITY CHARTER
OF THE CITY OF CORPUS CHRISTI, THE CITY CODE OF THE CITY-OF CORPUS CHRISTI, AND
OTHER ORDINANCES OF THE CITY OF CORPUS CHRISTI SHALL BE CONSTRUED TO MEAN
" FIRE DEPARTMENT ".
SECTION 3. THE DEPARTMENT OF PUBLIC SAFETY IS HEREBY ABOLISHED.
SECTION 4. THE OFFICE OF THE DIRECTOR OF PUBLIC SAFETY IS HEREBY
ABOLISHED.

SECTION 5.. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION,
CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID OR
UNCONSTITUTIONAL BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION IT
SHALL NOT AFFECT ANY OTHER SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE,
WORD, OR PROVISION OF THIS ORDINANCE, FOR IT IS THE DEFINITE INTENT OF THIS
CITY COUNCIL THAT EVERY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD,
OR PROVISION HEREOF BE GIVEN FULL FORCE AND EFFECT FOR ITS PURPOSE.
SECTION b. THE NECESSITY TO MAKE THE CHANGES HEREINABOVE DESCRIBED
AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY'AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE
OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT
THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE
AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF
NOVEMBER, 1974.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
