AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AMENDED CONTRACT OF SALE WITH SAM PERKINS
FOR THE SALE BY THE CITY OF A PORTION OF
LOT 6, SECTION B, PAISLEY'S SUBDIVISION OF
THE HOFFMAN TRACT, SITUATED IN THE CITY OF
CORPUS CHRISTI, NUECES COUNTY, TEXAS, ALL
AS MORE FULLY SET FORTH IN THE CONTRACT, A
COPY OF WHICH IS ATTACHED HERETO AND MADE
A PART HEREOF, MARKED EXHIBIT "A "; AND
DECLARING AN EMERGENCY.
BE_IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That the City Manager be and he is hereby
authorized to enter into an amended contract with Sam Perkins
for the sale by the City of the City's interest in a portion of
Lot 6, Section B, Paisley's Subdivision of the Hoffman Tract,
situated in the City of Corpus Christi, Nueces County, Texas,
all as more fully set forth in the contract, a copy of which is
attached hereto, marked Exhibit "A ", and made a part hereof_
SECTION 2. Ordinance No. 12170 be and is hereby
repealed to the extent of conflict herewith.
SECTION 3. The necessity to authorize the City Manager
to enter into the aforesaid contract in order to facilitate
the sale of the parcel or tract of land described creates a
public emergency and an imperative.public necessity requiring;
the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, and having requested the suspen-
sion of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the day of December, 1974.

CONTRACT
THE STATE OF TEXAS X
COUNTY OF NUECES X
This contract, by and between Mr. Sam Perkins,
hereinafter referred to as "BUYER ", and the City of Corpus
Christi, Texas, a municipal corporation, hereinafter referred
to as "CITY ",
W I T N E S S E T H:
WHEREAS, the City is the owner of certain surplus
property as hereinafter described; and
WHEREAS, the City has taken bids for the sale of said
surplus property in accordance with appropriate statutory and
Charter provisions; and
WHEREAS, Buyer desires to purchase said surplus
property; and
WHEREAS, certain amendments to the now existing contract,
authorized by Ordinance No. 12170 are desired by both parties;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that
City and Buyer do enter into the following amended agreement:
I
The City hereby agrees to convey the following described
property to Buyer in accordance with the terms and provisions
hereinafter set out:
Being a tract of land 25 feet in width and
210 feet in length out of the North one -half
of the East one - quarter of Lot 6, Section B,
Paisley's Subdivision of the Hoffman Tract.
II
Buyer agrees to pay the City, as consideration for
the above described premises, the sum of Nine Hundred ($900)
Dollars.
III
Buyer agrees that the Warranty Deed to be delivered
by the City upon receipt of the purchase price shall contain
retention of an easement of pedestrian access through the entire
property.

Buyer further agrees that the Warranty Deed to be
delivered by the City upon receipt of the purchase price will
contain a restriction that the conveyance will be effective
only so long as a portion of the abutting property is first
used'for public housing purposes in which the Housing Authority
of the City of Corpus Christi has participated, and that upon
failure of said use the conveyance shall become void and the
title to said property shall revert to the City of Corpus Christi,
its successors and assigns, who shall have the right to reenter
and repossess itself of same. Upon failure of said use, Buyer
shall be returned the Nine Hundred Dollars ($900) consideration
expended for the subject property.

It is further agreed that the Warranty Deed to be
delivered by the City will contain the following conditions,
violation of which shall cause an immediate reverter of the
above described property to the City:
1. A pedestrian access easement of 10 feet in width
shall be maintained by the grantee, said 10 foot
easement being shown on the plat attached hereto,
marked Exhibit "A ", and incorporated herein.
2. That grantee, within a reasonable time shall
construct a concrete walkway, at grantee expense,
4 feet in width along said easement.
3. In no case shall there be parallel buildings,
fences, walls or hedges less than 25 feet apart
in which the 10 foot pedestrian access easement
is located.

Buyer agrees to indemnify and hold harmless the City
from any liability and /or claims arising out of the execution
of this contract.

TO THE MEMBERS OF THE CITY COUNCIL
Corpus Christi, Texas
For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
