HomeMy WebLinkAbout12387 ORD - 12/11/1974JRR:vMR:12- 10- 711;1ST • AN ORDINANCE AMENDING THE CITY BUDGET; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH ASPHALT PAVING AND CONSTRUC- TION CO., INC., FOR THE CONSTRUCTION OF MAYFIELD DRIVE - STARLITE LANE AREA STORM SEWER LATERALS; APPROPRIATING OUT OF NO. 29''5 STORM SEWER BOND FUND $82,000, OF WHICH $75,14644.10 IS FOR THE CONSTRUCTION CONTRACT AND $6,535.90 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES ALL APPLIC- ABLE TO PROJECT NO. 295-72-6; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH ASPHALT PAVING & CONSTRUCTION CO., INC., FOR THE CONSTRUCTION OF MAYFIELD DRIVE - STARLITE LANE AREA STORM SEWER LATERALS, ALL AS IS MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE AND ACCORDING TO THE BID OF ASPHALT PAVING & CONSTRUCTION CO., INC., OPENED ON THE 27TH DAY OF NOVEMBER, 19744, SAID BID OF ASPHALT PAVING & CONSTRUCTION CO., INC. BEING THE LOWEST AND MOST ADVAN- TAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE NO. 295 STORM SEWER BOND FUND $82,000, OF WHICH $75,41614.10 IS FOR THE CONSTRUCTION CONTRACT AND $6,535.90 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT N0. 295 -72 -6. SECTION 3. AMENDMENT OF THE CITY BUDGET TO ACCOMPLISH THE PURPOSES OF THIS ORDINANCE IS NECESSITATED FOR EMERGENCY EXPENDITURE IN GRAVE PUBLIC NECESSITY TO MEET UNUSUAL AND UNFORESEEN CONDITIONS, WHICH COULD NOT, By REASONABLE DILIGENT THOUGHT AND ATTENTION OF THE GOVERNMENT OF THE CITY OF CORPUS CHRISTI, HAVE BEEN INCLUDED IN THE CURRENT, ORIGINAL BUDGET OF THE CITY. SECTION 44. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE- SAID CONTRACT AND TO APPROPRIATE THE SUMS HEREINABOVE SET FORTH AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _.jL_DAY OF DECEMBER, 1974.
