HomeMy WebLinkAbout12399 ORD - 12/18/19740 JRR:jkh:hb:12 /17 /74:lst C] AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLU- TION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF GOOD HOPE CHEM- ICAL COMPANY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON APPROXIMATELY 168 ACRES OF SUBMERGED LAND ALONG THE LA OUINTA SHIP CHANNEL IN NUECES COUNTY, TEXAS, MORE PARTIC- ULARLY DESCRIBED HEREINAFTER FROM "R -10 ONE FAMILY DWELLING DISTRICT TO "I -3" HEAVY IN- DUSTRIAL DISTRICT; XEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Good Hope Chemical Company for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, December 18, 1974, at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 1 9399 Alum SECTION 2. That the zoning on the hereinafter described parcel or tract containing approximately 168 acres of submerged land located along the La Quinta Ship Channel, in Nueces County, Texas, be and the same is hereby changed from "R -IA" One Family Dwelling District to "I -3" Heavy Industrial District. TRACT ONE Being 8.46 acres of submerged land situated in Nueces County, Texas, in the waters of Corpus Christi Bay about 11 miles North 70° East from the County Seat at Corpus Christi, Nueces County, and embracing a portion of the State of Texas submerged Tract No. 3 in Corpus Christi Bay lying Southwest of the Northeast shoreline of Corpus Christi Bay, between a Southwesterly extension of the boundary line between the Humble Oil and Refin- ing Company Tract and the R.H. Welder Tract and the North shore of Donnel Point, and Northeast of a line crossing Corpus Christi Bay in a general Northwesterly Southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line. Said survey is a part of the Corpus Christi Bay submerged lands in Nueces County patented to Nueces County Navigation District No. 1 by the State of Texas on 31st July, 1951, and recorded in the Deed Records of Nueces County, Texas, in Vol. 522, Page No_ 202 -203, and described by metes and bounds as follows: Beginning at a 1" iron pipe set on the Northeast Shore- line of Corpus Christi Bay for a common corner between the Humble Oil 6 Refining Company Tract and the R.H. Welder Tract and the most Northerly corner of this survey; Thence with the meanders of said Corpus Christi Bay and Southwest boundary of said R. H. Welder Tract and North boundary of the submerged lands patented to Nueces County Navigation District no. 1 by the State of Texas South 15° 17' Fast 350.97 feet, South 1° 44' East 541.1 feet, South 11° 20'West 381.50 feet to a point in a line running in a Northwesterly Southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line, located parallel with, on straight courses and 200 feet Northeasterly, measured at right angles from the near bottom edge of the proposed 150 foot bottom width channel for the most southerly corner of this survey; Thence North 23° 45' 14" West, a distance of 1,237.79 feet, along the North Bulkhead line to the intersection of the North Bulkhead line with a line extended South- westerly from the common corner between the Humble Oil and Refining Company Tract and the R. H. Welder Tract on the shoreline of Corpus Christi Bay for the most Westerly corner of this survey; Thence North 75° 17' 21" East, a distance of 479.75 feet, to the shoreline and the common corner between the R. H. Welder Tract and the Humble Oil and Refining Company Tract and place of beginning and containing 8.46 acres of land more or less. All bearings are based on Grid North for Texas, South Zone as established by U. S. Coast 6 Geodetic Survey. -2- • TRACT TWO Being 160 acres more or less of submerged land situated in Nueces County, Texas, in the waters of Corpus Christi Bay about 11 -1/2 miles South 75° East from the County Seat at Corpus Christi, Nueces County, and embracing a portion of the State of Texas submerged Tracts Nos. 3, 4, and 5 in Corpus Christi Bay lying Southwest of the Northeast shoreline of Corpus Christi Bay, between the south shoreline of Donnel Point and a Southwesterly ex- tension of a line from the head of Kinney Bayou, and North- east of a line crossing Corpus Christi Bay in a general Northwesterly Southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line. Said survey is a part of the Corpus Christi Bay submerged lands in Nueces County patented to Nueces County Navigation District No. 1 by the State of Texas on 31st of July, 1951, and recorded in the Deed Records of Nueces County, Texas, in Vol. 522, Page No. 202 -203, and described by metes and bounds as follows: Beginning at a point on the South shoreline of Donnel Point where the North shoreline of Corpus Christi Bay intersects a line referred to as the Nueces County Navigation District North Bulkhead line for the most Northerly corner of this survey; Thence with the meanders of said Corpus Christi Bay and Southwest boundary of said R. H. Welder Tract and North= east boundary of the submerged lands patented to Nueces County Navigation District No. 1 by the State of Texas South 52° 19' East 402.35 feet, South 410 36' East 1201.6 feet, South 28° 55' East 647.6 feet, South 19° 42' East 886 feet, South 26° 52' East 244.7 feet, South 77° 32' East 269.5 feet, South 51° 28' East 668 feet, South 45° 56' East 483 feet, South 56° 49' East 336.9 feet, South 52° 34' East 477.8 feet, South 67° 46' East 349.6 feet, South 70° 15' East 164.7 feet, South 83° 35' East 137.4 feet to the beginning of Kinney Bayou: Thence with the meanders and West shoreline of said Kinney Bayou North 55° 35' East 167.7 feet, North 45° 07' East 431.32 feet, North 55° 18' 30" East 627.4 feet; Thence South 15° 30' West to a point located midway between the East and West banks of Kinney Bayou for a corner of this survey; Thence South 15° 30' West, to a point located midway between the East and West banks of Kinney Bayou for a corner of this survey; Thence South 50° 41' 10" West, a distance of 5000.55 feet to a point in a line running in a Northwesterly Southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line, located parallel with, on straight and concentric courses and 200 feet Northeasterly, measured at right angles from the near bottom edge of the proposed 150 foot bottom width channel for the most Southerly corner of this survey; Thence North 23° 45' 14" West, a distance of 6706.78 -3- • �J • feet along the North Bulkhead line to the inter- section of the North Bulkhead line with the South shoreline of Donnel Point and the place of beginning and containine 160 acres of land more or less. All bearings are based on Grid North for Texas, South Zone as established by U. S. Coast & Geodetic Survey. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage.
