AN ORDINANCE
AMENDING THE CITY BUDGET: AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH BURTER CON-
STRUCTORS, INC., FOR CONSTRUCTION OF AUSTIN SCHOOL
AREA IMPROVEMENTS, UNIT II; APPROPRIATING OUT OF
110. 220 STREET BOND FUND $820,000 OF WHICH
$796,375.13 IS FOR THE CONSTRUCTION CONTRACT AND
$23,624.87 IS FOR CONTINGENCIES AND INCIDENTAL
EXPENSES, ALL APPLICABLE TO PROJECT NO. 220 -72-
1.2; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY'THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Burtex Constructors, Inc., for the construction
of Austin School Area Improvements, Unit II, all as is more fully described
in the plans and specifications and contract documents on file in the office
of the City Secretary, all of which are made a part hereof by reference
and according to the bid of Burtex Constructors, Inc., opened on the 13th
day of November, 1974, said bid being the lowest and most advantageous
to the City of Corpus Christi.
SECTION 2. That there is hereby appropriated out of the
No. 220 Street Bond Fund $820,000, of which $796,375.13 is for the con-
struction contract and $23,624.87 is for contingencies and incidental
expenses, all applicable to Project No. 220- 72 -1.2.
SECTION 3. Amendment of the City Budget to accomplish the
purpose of this ordinance is necessitated for emergency expenditure in
grave public necessity to meet unusual and unforeseen conditions, which
could not, by reasonable diligent thought and attention of the Government
of the City of Corpus Christi, have been included in the current original
Budget of the City.
SECTION 4. The necessity to authorize the execution of the
aforesaid contract and to appropriate the sum hereinabove set out at the
earliest practicable date so that construction may be commenced without
delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolu-
tion shall be passed finally on the date of its introduction and that

such ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor, having declared such emergency and
necessity to exist, having requested the suspension of the Charter rule
and that this ordinance take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED this the OTU
of January, 1975.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
