AN ORDINANCE
AMENDING THE CITY BUDGET; AUTHORIZING THE CITY MANAGER
TO EXECUTE A CONTRACT WITH HELDENFELS BROTHERS FOR
CONSTRUCTION OF THE WILLIAMS DRIVE DRAINAGE IMPROVEMENTS;
CANCELLING THE RESERVE APPROPRIATION OF $200,000 IN
ACTIVITY 6704 OF THE N0. 124 GENERAL REVENUE SHARING FUND
FOR THE NUECES BAY BOULEVARD IMPROVEMENTS AND $70,000
OF THE REMAINING APPROPRIATION OF $238,826 IN ACTIVITY
3554, OF THE NO. 123 GENERAL REVENUE SHARING FUND FOR THE
PURCHASE OF LANDFILL EQUIPMENT, AND REAPPROPRIATING SAID
FUNDS TO ACTIVITY 5682, WHICH AMOUNT WILL BE TRANSFERRED
TO THE NO. 295 STORM SEWER BOND FUND FOR PROJECT NO.
295 -72 -5, WILLIAMS DRIVE DRAINAGE IMPROVEMENTS; APPROPRIATING
AND REAPPROPRIATING $1,150,000 OUT OF THE NO. 295 STORM
SEWER BOND FUND, OF WHICH $1,118,161.50 IS FOR THE CON -
STRUCTION CONTRACT AND $31,838.50 IS FOR INCIDENTAL AND
RELATED EXPENSES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Heldenfels Brothers for construction of the
Williams Drive Drainage Improvements, all as is more fully described in the
plans and specifications and contract documents on file in the office of the
City Secretary, all of which are made a part hereof by reference and accord-
ing to the bid of Heldenfels Brothers, opened on the 15th day of January,
1975, the said bid of Heldenfels Brothers being the lowest and most advan-
tageous to the City of Corpus Christi.
SECTION 2. That there is hereby cancelled the reserve appropriation
of $200,000 in Activity 6704 of the No. 124 General Revenue Sharing Fund for
the Nueces Bay Boulevard Improvements and $70,000 of the remaining appropria-
tion of $238,826 in Activity 3554 of the No. 123 General Revenue Sharing
Fund for the purchase of landfill equipment; and that the said funds are
hereby reappropriated to Activity 5682, which amount will be transferred to
the No. 295 Storm Sewer Bond Fund, for Project No. 295 -72 -5, Williams Drive
Drainage Improvements.
SECTION 3. There is hereby appropriated and reappropriated
$1,150,000 out of the No. 295 Storm Sewer Bond Fund, of which $1,118,161.50
is for the construction contract and $31,838 is for incidental and related
expenses, all in connection with the Williams Drive Drainage Improvements.

SECTION 4. Amendment of the City Budget to accomplish the purposes
of this ordinance is necessitated for emergency expenditure in grave public
necessity to meet unusual and unforeseen conditions, Which could not, by
reasonable diligent thought and attention of the Government of the City of
Corpus Christi, have been included in the current, original Budget of the
City.
SECTION 5. That the necessity to execute the aforesaid contract
and to provide the necessary sums in order that the construction may commence
without delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
