AN ORDINANCE
ORDERING AN ELECTION TO BE HELD ON THE 1ST DAY OF
MARCH, 1975, AT WHICH ELECTION THERE SHALL BE SUB-
MITTED TO A VOTE OF THE QUALIFIED VOTERS OF THE CITY
OF CORPUS CHRISTI THE QUESTION OF WHETHER OR MOT TO
ADOPT THE STATE LAW APPLICABLE TO COLLECTIVE BARGAIN-
ING FOR FIREFIGHTERS AND POLICEMEN IN THE CITY OF
CORPUS CHRISTI; PROVIDING FOR THE HOLDING OF SUCH
ELECTION, INCLUDING NAMING OF CERTAIN OFFICIALS TO
CONDUCT SUCH ELECTION; SETTING FORTH THE PROPOSITION
TO BE VOTED ON AT SAID ELECTION; PROVIDING FOR NOTICE
OF SUCH ELECTION; PROVIDING FOR SEVERABILITY; AND
DECLARING AN EMERGENCY.
WHEREAS, the City Council finds that a petition on the question
of whether or not to adopt the State law applicable to collective bargain-
ing for Firefighters and Policemen in the City of Corpus Christi, filed
with the City Secretary on December 31, 1974, has been certified as
validated to the City Council by the City Secretary on January 6, 1975,
and that such petitioned question must be incorporated on the ballot for
the election of Saturday, March 1, 1975:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That an election is hereby ordered to be held on
Saturday, March 1, 1975, in the City of Corpus Christi, Texas, at which
election shall be submitted to the voters who are qualified to vote under
the Constitution and Laws of the State of Texas, the following question,
as set out on the official ballot hereinafter prescribed.
SECTION 2. The official ballot for the registering of the
"Yes" or "No" vote of the voters voting on the proposition shall be set
out in Section 3 hereof, on the proposition to be voted on at said
election, which proposition is as follows:
PROPOSITION
Shall the City Council of the City of Corpus Christi
be authorized to enact an ordinance adopting the state
law applicable to Firefighters and Policemen, which
establishes collective bargaining when a majority of
the affected employees favor representation by an
employees' association and which preserves the prohibi-
tion of strikes and lockouts and provides penalties
therefor, as more fully set forth in Section 5(b),
Article 5154c -1, Vernon's Annotated Texas Statutes.
SECTION 3. The ballots for said election shall be in such form
as those voters intending to vote "Yes" shall show on their ballot a vote
"FOR" the proposition, and those intending to vote "No" shall show on
their ballot "AGAINST ". The proposition shall appear on said ballot
as follows:
PROPOSITION
FOR adoption of the state law applicable to Firefighters
and Policemen which establishes collective bargaining
when a majority of the affected employees favor repre-
sentation by an employees' association and which
preserves the prohibition of strikes and lockouts and
provides penalties therefor.
AGAINST adoption of the state law applicable to Fire-
fighters and Policemen which establishes collective
bargaining when a majority of the affected employees
favor representation by an employees' association and
which preserves the prohibition of strikes and lockouts
and provides penalties therefor.
SECTION 4. The election shall be held pursuant to Article 1170,
R.C.S., Texas, and the general laws of Texas pertaining to elections
insofar as such are applicable hereto. Said election shall be held in the
City of Corpus Christi, Texas, at the following places, being the City's
regularly prescribed voting precincts, and the following named persons
are hereby appointed, pursuant to City Charter Article IX, Section 19,
judges and alternate judges:

The presiding judge of each polling place is authorized to select such
clerks and other assistants as required by law and as deemed further
necessary for the conduct therein of the election.
SECTION 5. Voting machines shall be employed at the election
herein ordered pursuant to the Texas Election Code, V.T.S., Article 7.14,
as amended.
Absentee voting shall commence February 10,1975, and the last
day of absentee voting shall be February 25, 1975. The City Secretary
shall conduct absentee voting at the City Hall and the results shall be
canvassed and returns made as provided by law.

SECTION 6. The polls shall be open from 7:00 o'clock A.M. to
7:00 o'clock P.M. on the date of said election.
SECTION 7. An executed copy of this ordinance shall constitute
the notice ordering said election and the Mayor, and in his default of
so doing, the City Secretary, is directed to cause a copy of this ordinance
to be posted at the City Hall in the City of Corpus Christi, Nueces County,
Texas, and at each of the polling places in each precinct of the City,
said posting to be not less than fifteen (15) days prior to said election,
and to have a copy of this ordinance published in the Corpus Christi
Times, the official newspaper of the City of Corpus Christi, Texas, being
a newspaper of general circulation published within the city, said publica-
tion to be made in accordance with the requirements of Article 1170,
R.C.S. of Texas, as amended.
SECTION 8. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph, subdivision,
clause, phrase, word or provision hereof be given full force and effect
for its purpose.
SECTION 9. The public importance of the question involved and
the requirement of the City Charter requiring the submission of such
question and the necessity for determining whether or not the qualified
voters desire to authorize enactment of an ordinance providing for
collective bargaining applicable to Firefighters and Policemen creates
a public emergency and an imperative public necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor, having declared such emergency and necessity to exist,
