AN ORDINANCE
AMENDING ORDINANCE NO. 12459, PASSED AND APPROVED
BY THE CITY COUNCIL ON JANUARY 29, 1975, SO AS TO
AMEND THE CONTRACT AUTHORIZED BY SAID ORDINANCE SO
AS TO PROVIDE FOR A PAYMENT TO THE COUNTY TO CARRY
OUT AN INTERGOVERNMENTAL PROGRAM WITH THE COUNTY
BEING RESPONSIBLE FOR ALL RULES AND REGULATIONS
REGARDING THE PROGRAM; ALL IN ACCORDANCE WITH THE
ATTACHED CONTRACT WHICH IS MARKED EXHIBIT "A" AND
MADE A PART HEREOF THE SAME AS IF COPIED HEREIN;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That Ordinance No. 12459, passed and approved by the
City Council on January 29, 1975, be and the same hereby is amended so as to
amend the contract authorized by said ordinance to provide for a payment to
Nueces County to carry out an intergovernmental program with the County being
responsible for all rules and regulations regarding the program, all in
accordance with the contract attached hereto as Exhibit "A ', which is incor-
porated herein by reference the same as if written herein.
SECTION 2. That except as herein and hereby amended, the terms
and conditions of Ordinance No. 121159 shall be and remain in full force and
effect and are hereby saved from repeal.
SECTION 3. The imperative necessity to amend the aforesaid contract
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this
the day of February, 1975.

CONTRACT
THE STATE OF TEXAS
COUNTY OF NUECES
WHEREAS, it is generally recognized that the United States of
America is currently undergoing an energy crisis, which crisis is further
complicated by rising inflation; and
WHEREAS, these economic factors are reflected in increasing utility
bills to the ultimate consumers; and
WHEREAS, specifically in the City of Corpus Christi the fuel adjust-
ment clause reflecting rising cost of natural gas has led to dramatically
increased utility bills for the citizens of the City of Corpus Christi; and
WHEREAS, the City Council specifically finds that assisting citizens
in meeting this crisis is beneficial to the public health, safety, and welfare
by alleviating undue use of natural gas, conserving energy, and fighting
inflation:
NOW, THEREFORE, for and in consideration of the payments, agreements,
and covenants herein, do the City of Corpus Christi, a municipal corporation,
body politic and home rule city under the laws of the State of Texas, herein-
after called "CITY" and the County of Nueces, hereinafter called "CONTRACTOR ",
covenant, agree and contract as follows:
1. Contractor agrees to establish, direct, and conduct a program
through its Welfare Division to furnish services to assist in alleviating the
aforesaid energy - inflation crisis as reflected in rising utility bills. This
program will entail establishing a program of assisting utility users who are
welfare recipients meet the rising cost of utility services through counsel-
ing, energy conservation, and other related services as determined by said
Division. Contractor agrees to establish rules and regulations regarding
such program.
2. For and in consideration of the provision of the above services
to the citizens of this area, in furtherance of their general health, safety,
and welfare, and to help fight rising inflation and the energy crisis, the
City agrees to pay for said services the sum of Thirty Thousand, Six Hundred
and Ten Dollars ($30,610).

3. Contractor agrees to furnish to the City copies of its regular
reports of services by transmitting a copy of same to the office of the City
Manager. Contractor agrees and covenants that said reports will clearly
indicate provision of the services contemplated herein and in the event the
City determines said reports do not contain the necessary information, Contractor
agrees to supply additional or supplemental reports providing additional
information requested by the City.
4. This contract contemplates the provision of certain services and
as such is not for any length of time but shall expire upon completion of the
provision of the services contemplated herein.
5. It is specifically agreed that City shall pay the incremental
costs of staffing necessary to carry out this program, now estimated to be
One Thousand Seven Hundred Dollars ($1,700) per month for a period of time
now estimated to be not more than three months.
6. It is further agreed that only those persons residing in the
corporate limits of the City of Corpus Christi are eligible to apply for
participation in the above described program.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
