AN ORDINANCE
AMENDING THE CITY BUDGET; AUTHORIZING THE CITY MANAGER
TO EXECUTE A CONTRACT WITH ASPHALT PAVING AND CON-
STRUCTION COMPANY FOR CONSTRUCTION OF THE SANTA FE
DRAINAGE IMPROVEMENTS (LORRAINE DRIVE DRAINAGE IMPROVE-
MENTS - 1972 BOND PROGRAM); APPROPRIATING $72,000 OUT
OF THE NO. 295 STORM SEWER BOND FUND, OF WHICH $67,458.33
IS FOR THE CONSTRUCTION CONTRACT AND $4,541.67 IS FOR
RELATED AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT
NO. 295 -72 -8; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Asphalt Paving and Construction Company for
construction of the Santa Fe Drainage Improvements (Lorraine Drive Drainage
Improvements - 1972 Bond Program), all as more fully described in the plans
and specifications and contract documents on file in the office of the City
Secretary, all of which are made a part hereof by reference and according to
the bid of Rome Construction Company opened on the 12th day of February,
1975, said bid of Asphalt Paving and Construction Company being the lowest
and most advantageous to the City of Corpus Christi.
SECTION 2. There is hereby appropriated $72,000 out of the No. 295
Storm Sewer Bond Fund, of which amount $67,458.33 is for the construction
contract and $4,541.67 is for related and incidental expenses, all applicable
to Project No. 295 -72 -8.

SECTION 3. Amendment of the City Budget to accomplish the purposes
of this ordinance is necessitated for emergency expenditure in grave public
necessity to meet unusual and unforeseen conditions, which could not, by
reasonable diligent thought and attention of the Government of the City of
Corpus Christi, have been included in the current, original Budget of the
City.
SECTION 4. The necessity to execute the aforesaid contract and to
appropriate the sums hereinabove set out at the earliest practicable date in
order that the drainage improvement project may be commenced without delay
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and

the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this
the Zday of February, 1975.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
