AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH THE STATE DEPARTMENT OF PUBLIC WELFARE, TO
PROVIDE QUALITY DAY CARE FOR CHILDREN OF MOTHERS
TEO ARE RECEIVING AFDC IN THE CORPUS CHRISTI AREA,
INCLUDING HEALTH AND SOCIAL SERVICES, NUTRITION
AND PARENT INVOLVEMENT, IN ACCORDANCE WITH THE SAID
CONTRACT, SUBSTANTIALLY IN THE FORM ATTACHED HERE-
TO AND MADE A PART HEREOF FOR ALL PERTINENT PUR-
POSES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute, for and on behalf of the City of Corpus Christi, a contract
with the State Department of Public Welfare to provide quality day care
for children of mothers who are receiving AFDC in the Corpus Christi area,
including health and social services, nutrition and parent involvement,

payment for these services is provided by the State Department of Public
Welfare, plus a sum of $8,000 annually to reimburse the City for the
administrative expenses, all as more fully set forth in the contract, in
substantially the form attached hereto, marked Exhibit "A ", and made a
part hereof.
SECTION 2. The necessity to authorize execution of the afore-
mentioned contract at the earliest practicable date for the purposes
therein set forth creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction and
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor, having declared such emergency and
necessity to exist, having requested the suspension of the Charter rule
and that this ordinance take effect and be in full force and effect from

PROVIDER CONTRACT
The Texas Department of Public Welfare, hereinafter referred to as the Department,
and City of Corpus Christi, a municipal corporation, body politic, ope-fating
under the home rule statutes of the State of Texas,
hareinafter referred to as the Contractor, do hereby make and enter into this contract which constitutes
the entire agreement under the above number between the Contractor and the Department and which
supersedes 'any previous contract or agreement under said number, and all amendments thereto, which may
have been entered into by and between the Contractor and the Department
The Department is the single Texas state agency responsible for administering the public welfare programs
under the Social Security Act Federal law and regulations, as well as state law, in TEX. REV. CIV.
STAT. ANN, art 695c g 402), permit and authorize the Department subject to certain limitations, to
enter into agreements with public or private agencies for the purpose of providing social and/or other
services for the benefit of eligible individuals and to accept and expend funds received from public or
private agencies for such purposes. Since the Contractor desires to provide services for the benefit of
cwWn eligible indhriduals, as described herein, the Department and the Contractor make this contract
The parties hereto mutually agree:
A. The scope and coverage of the services to be provided by the Contractor and /or subcontract
agencylies) under this contract, and the personnel plan and budget for these services, as well as such
other components as may be necessary, are described and included in the attached plan(s) of
Operation. Such Plan(s) of Operation has (have) been submitted by the Contractor and approved by
the Department and such Plan(s) is (are) hereby incorporated in this contract in its- (their) entirety
by specific reference, The Plan(s) will be maintained on file with the Department as a part of this
contract Any change, modification or amendment thereto, or renewal thereof, must be made with the
prior written approval of the Department except as otherwise provided in this contract and any such
change, modification or amendment to, or renewal of, such Plan(s) is not effective until approved by
the Department. Such original Plan(s) of Operation together with any approved amendmant as
maintained on file by the Department will be considered to be the controlling instruments in case
any dispute arises relative to the wording of any portion of such Plan(s) of Operation or amendment
thereto.
R. The basis for payment for services rendered under this contract is indicated in the attached Plan(s) of
Operation. Such basis will be expenditures made within the budget, which has been submitted by the
Contractor and approved 'by the Department The Plan(s) of Operation, including the basis for
payment, will be periodically reviewed, and reviewed In its entirety at least once annually. In no case
will the Department be obligated to pay in excess of the Conructot's actual cost.
Should it be determined, by the Department as a result of periodic reviews) and/or audit(s), that an
overpayment has occurred, such overpayment shall be refunded by the Contractor to the Department

Items of a budget will be allowed without prior approval If such transfers do not result in a
cumulative increase or decrease in any budget item of more than One Thtmsend Dollars fS1,000) (or
a prorated portion of SUCH amount in cases where the term is for lass than one year) or one
percent (i%) of the total budget, whichever is greater. Such shifts must be described and reported
Promptly by letter. Funds will not be available in excess of the total approved amount of the budget
as originally approved or subsequently amended. Prio►.written approval must be secured;
1. When a transfer between items of more than the above designated amount is involved, lack of
prior approval in these instances will be grounds for refusal of the payment of the Item or items
Involved.
Z. When a transfer, regardless of the amount, would result in a significant change in the character
or scope of the program, lack of prior approval in these instances will be grounds for recovery
of such unapproved payments and /or termination of this contract at the option of the
Department
C. The Department, the Contractor and all subcontractors, if any, will carry out the requirements for the
provision of services as set forth in Chapter II, Title 45 of the Code of Federal Regulations, as
amended, to monitor and conduct fiscal and /or program audits at reasonable times and provide
consultative and technical assistance for the continuous development of the services contemplated by
this contract The authority of the Department to monitor and conduct ftscel and /or program audits
applies both to the Contractor and its subcontractnr(s) to the extent of services provided under the
temp of this contract Access at reasonable times to all books and records will be granted to
representatives of the United States Department of Health. Education, and Welfare and /or the Texas
Department of Public Welfare when It is deemed necessary by the Department for purposes of
inspection, monitoring, auditing or evaluating said materials.
D. The term of this contract will begin with the' effective date hereinafter mentioned and will continue
for the period of time that operational funds and services are provided in accordance with the
approved Plants) of Operation. However, this contract is subject to the availability of state and /or
federal funds and if such funds become unavailable, or if the total amount of funds allocated
hereunder should become depleted during any budget period and the Department Is unable to. obtain
additional funds for such purposes, then this contract will be terminated.
in the event that the Contractor faits to provide services in accordance with the approved Plants) of
Operation and in accordance with the provisions of this contract, the Department may, upon written
notice of default to the Contractor, terminate the whole or any part of this contract, and such
termination shall not be an exclusive remedy but shall be in addition to any other rights and
remedies provided-by law or under this contract
Furthermore, in the event that federal or state laws or other requirements should be amended or
ludicially interpreted so as to render continued fulfillment of this contract, on the part of dither
party, substantially unreasonable or impossible, or if the parties should he unable to agree upon any
amendment which would therefore be needed to enable the substantial continuation of the services
contemplated herein, then, and in that event, the parties shall be discharged from any further
obligations created under the terms of this contract, except for the equitable settlement of the
respective accrued interests or obligations incurred up to the date of termination.
E. This contract may be cancelled by mutual consent, however, if such mutual consent cannot be
attained, then and in that event, either parry to this contract may consider it to be cancelled by the
giving of sixty (60) days notice in writing to the other party and this contract shall thereupon be
cancelled upon the expiration of such sixty (60) day period.

13. Provide to die Department, in accordance with the procedures prescribed by the Department, a
verified and proper monthly statement of charges for services which have been rendered under this
contract
C. Hire or promote only such personnel who can meet specific qualifications as set forth in the Job
descriptions which have been approved as a part of the Plan(s) of Operation unless a waiver of a
specific required qualification is obtained in writing from the Department prior to the hiring or
promotion of the individual involved.
D. Refrain from entering into any subcontract(s) for services without prior approval or waiver of the
right of approval in writing by the Department of the qualifications of the subcontractor(s) to
perform and meet the standards fixed by this contract and its attached Plan(s) of Operation.
E. Observe regulations as specified by the Department of Public Welfare as they relate to particular
programs in providing the services contemplated under this contract
F. Comply with appropriate state licensing requirements and with such standards as may be prescribed by
the Secretary of the United States Department of Health. Education, and Welfare.
G. Fumish the Department with various monthly statistical reports as required by the Department in the
format prescribed by the Department
H. Make available at reasonable times and for reasonable periods those books and supporting documents
kept current by the Contractor and its subcontractor(s) pertaining to these services for purposes of
inspection, monitoring, auditing or evaluating by Department personnel or their representatives.

and abide by the decisions rendered by the Department in such hearings.

L. Establish a method to secure the cortridentiality of records relating to clients In accordance with the
applicable federal law, rules and regulations, as well as the applicable state law and regulations.
M. Assume responsibility for the protection; at all times, of all physical property and equipment used at
the facility or facilities being maintained to carry out the Plan(s) of Operation and take appropriate
measures to insure meeting this obligation. *The Contractor must furnish the Department with a
written factual report of the theft of, or damage to, any equipment which was purchased under this
contract, including the circumstances concerning such loss arid, in the event of any theft, vandalism,
or other offense against said property, must notify appropriate local law enforcement authorities.
N. Permanently identify all equipment purchased under this contract by appropriate tags or labels affixed
thereto and maintain a current inventory of such equipment which will be available to the
Department at all times upon request
O. Dispose of any equipment bought under this contract with funds allocated to the Contractor or its
subcontractor(s) in keeping with the federal taws, audit requirements, rules or regulations, as well as
any state laws, rules or regulations, if this contract is terminated for any reason.
P. Maintain and retain case information concerning those individuals and families who received services
and supporting fiscal documents adequate to assure that claims for federal matching funds are in
accord with applicable federal requirements. Said documents shall be maintained and retained by the
Contractor and all subcontractors, if any, for a period of three (3) years after the oate of submission
of the final expenditure report. In the event that audit by or on behalf of the United States
Department of Health, Education, and Welfare occurs, documents will be retained until the resolution
of audit questions.

by this contract which is found to exist after monitoring or auditing by the Department or the
United States Department of Health. Education, and Welfare, and be primarily- responsible for the
Collection and proper reimbursement of any amount paid in excess of the proper billinil amuunt

The Contractor further agrees:
A. To provide the Department with detailed statements of expenditures each month developed in the
format prescribed by the Department, and to promptly forward such bill to -the Department along
with a statement certifying' that.the Contractor has expended One Hundred percent (100%) of the
total approved bill for each service for that month in accordance with procedures prescribed by the
Department
B. That funds certified by the Contractor for matching purposes in accordance with the terms of this
contract will be funds which can be used to match federal funds under -the Social Security Act and
'appropriate federal rules and regulations.
C. That to reimburse the Department for administrative and other operational costs incurred in procuring
matching federal funds, the Department shall be entitled to retain from any federal matching funds an
amount equal to five percent (55A) of the total amount certified to the Department as having been
expanded.

A. Reimburse the Contractor for the following percent of the approved monthly expenditures for each
service which has been rendered on a budget basis in accordance with the terms of this contract and
its attached Plan(s) of Operation, upon receipt of a proper and verified statement after deducting
therefrom all payments for services made by or on behalf of any recipient and/or any previous
.overpayment made by the Department 7n7'
B. Recognize the fiscat policies and procedures of the Contractor and its subcontractor(s), if any, except
where they are in. conflict with generally accepted accounting procedures or federal and state taws,
policies, rules and regulations,
C. Perform such evaluation studies that the Department determines to be necessary and report to the
appropriate officers of the Contractor and its subcontractor(s), if any, the preliminary results of the
study before the evaluation is concluded and the fundErhgs made a matter of record.
D. Conduct a financial audit of Early Childhood Development Center program expendi-
tures incurred prior to the date of assumption of sponsorship by City and to
provide a copy of such audit to City.
E. Hold City harmless from any financial liability for any audit exceptions which
occurred prior to assumption of sponsorship by City.

The Early Childhood Development Center, 1417 Horne Road, Corpus Christi, Texas will serve
children from birth up to four years of age living with the Corpus Christi City limits. Children
will be retained for 6 few months past their fourth birthday when they have to wait for the end
of a semester to enter Headstart or other child care arrangements. Within Nueces County, there

The above data was obtained from the State Department of Public'
Welfare, Region 04 from their AFDC files of December 1974.
3. List other existing community resources providing this service, indicate their
basis of fees for ')PW related clients, and document crhy this need for service
continues to exist:
There are 24 non - profit day care centers operating in the city limits of Corpus
Christi. DPW related clients usually pay on a sliding fee scale basis, however,
six of these centers charge a commercial rate. Only one of these centers offers
infant day care. At present there are 144 children on the waiting list for
infant day care services at the ECDC. This is obviously a need source in Corpus
Christi particularly for the low income working mother. There are only two other
Title N -A contract centers in Corpus Christi that can provide day care at no or
little to the eligible DPW related clients.
EARLY CHILDHOOD DEVELOPMENT CENTER OBJECTIVES
1. The Early Childhood Development Center will enroll 68 children from birth to
four, from families currently receiving Aide to Families with Dependent
Children (A.F.D.C.) and offer a comprehensive Child Growth and Development
program for each child on the basis of his individual needs. (If monies become
available, we could enroll potential and past AFDC recipients.)
Measure: Enrollment_of 68 children from birth to four from categorically related
A.F.D.C. families written individual program and progress documentation.
2. A planned nutrition program on the basis of the needs of the children with special
diets for children needing individual diets.
Measure: A plan showing a nutritious cycle of food as planned by the Center
cook and nutrition consultants.
3. A continuing inservice education program for the staff development will be planned
and implemented
Measure: A written narrative and a time line will be developed indicating the
specific Staff Development activities for the program year. Each staff
member will be expected to achieve observable competencies to also
be listed in Staff Development plan.

4. Delivery of Social Services will be cooperative endeavor of a social worker on
the Director's staff nurse and the teaching staff.
Measure: Documentation will be recorded and kept on file at the Center on all
activities and services rendered to enrolled families (e.g. counseling,
therapy, referrals, job placement, parent education, nutrition education, etc.)
5. Parent involvement will be a component of the Early Childhood Development Center.
Measure: Consumers education: Parents will participate in the Parents Advisory
Group, representative will serve on the Board of Trustees and be a dele-
gate to Child and Youth Development Council. Records will be kept on
file at the Center of all meetings and sessions that parents attend and
a log of hours of parent involvement will also documented. Parents
involved as volunteers at the Center will also undergo physicals and T.B.
tests. At parent meetings, scheduled once monthly, parents will participate
in formulating policies for ECDC, Inc. and be educated in matters relating
to child care.

will be submitted to a professional nutritionist fpr her consultation and
approval. Additionally SDPW will be requested to provide continuous
food service programs at least twice annually.

Application was filed and approved with the USDA Special (rood Service
and the Center -received reimbursements for 68 children. Commodities
are used to supplement the food program. The cycle menus are planned
around seasonal foods.

The social worker and nurse work a follow -up on -going health program
with individual parents. Occasionally, health- related items are discussed
at parent meetings.

Nurse has follow -up program on immunizations. Nurse has a record
of immunizations and talks to mothers to get the children up -to -date.
Transportation is provided by the Center for immunizations.

and to help develop good attitudes tovard their bodies and

Cleanliness and grooming 'are stressed in the rooms for health activities.
Teachers provide training for children in the area of health with acti-

Nurse conducts daily inspection as children enter the Center. Teacher

EARLY CHILDHOOD DEVELOPMENT CENTER, INC. PLAN OF OPERATION
ENROLLMENT OF CLIENTS
Children may be enrolled at the Early Childhood Development Center, Inc. provided they
meet the following criteria:
(1) Present AFDC recipients
(2) Must live within the city limits
(3) Age, Birth - four years
(4) Mother is incapacitated, in training, school, working or seeking work and /or
training.
REFERRALS
The local State Department of Public Welfare will be responsible for referrals to the Early
Childhood Development Center, Inc. Current referrals recipients will be made in writing
with.a statement of need for services before entitlement is done by Center's Social Worker.
Walk -in clients will make application with the ECDC Social Worker who will then confer
with the DPW worker to evaluate enrollment status of client.
Statement of need will be filed in the Center's Record file.
ENTITLEMENT
Entitlement information is obtained by the Early Childhood Development Center's Social
Worker and subsequently approved by the Department of Public Welfare worker prior to
enrollment of the client into the program.
FAMILY SOCIAL HISTORY AND INTAKE INFORMATION
After entitlement, the Social Worker will complete a Social History workup and other
Intake Information which will be filed in Center's Record file:
PSYCHOLOGICAL ASSESSMENT
A Social Worker will refer and schedule clients for psychological testing, if necessary.
Psychological assessment reports will be mailed to Program Director to be shared with the
Social Worker, and other personnel to be directly involved with a child and will be filed
in Center's Central Record File. This will only be done in case of need and not with
every child.

A Social Worker and Nurse will coordinate with the designated Pediatrician for physicals
to be done on prospective Center recipients. Statements from Physicians certifying child's

informing and offering information to client's on immunizations. The Center's nurse will

the parents to sh_are Family Social History, Psychological Assessment and any other infor-
mation available in order to formulate a plan for the total family.

involvement: (1) Individual Counseling (2) Educational meetings. The educational meetings

The parents role in the decision- making process comes through their participation in the
Parents Advisory Council. They can also effect change by direct communication with

1. A log of long distance calls will be maintained.
2. The evaluator will submit vouchers to document expenditures before receiving
reimbursements as stated in contract.
3. Consultants for workshop and training. The maximum rate will be $100 /day and
$150 travel at 12� a mile or plane fare (actual). Two days specially authorized
@ $150 /day.
4. A tax exempt status and USDA special foods program have been applied for and
this amount will be adjusted when these are received.
5. This includes Medical Examination:
a) Special rate of $5 each for a group examination for 45 children - $225

6. Staff who eat with and assist the children will receive their meals. Mealtimes
and snack times are not only nutritionally important but also provide unique
learning experiences for the children (good attitudes toward new foods, table
manners, self - expression through conversation, etc.). These are best taught
through association with appropriate models (staff). Additionally, meals are
also provided to the Director, Social Worker, Supervisory Teacher, and Secretary
(who should take every opportunity to dine with the children), to facilitate their
remaining on the center premises at midday.

The Lessee shall in case of fire, give immediate notice to the
Lessor, who Shall thereupon cause the damage to be repaired forthwith-,
but if the premisea be by the Lessee deemed ao damaged as to be unfit
for occupancy, or if the Lessor shell decide to rebuild, the Lease
shall cease and the rest paid up to the time of the fire.
VIII. COVENANTS BINDING
The agreements, conditions, covenants and terms herein contained,
shall in every case, apply to, be binding upon and insure to the benefit

the date of expiration. It is expressly agreed that Lessee shall give
Lessor thirty (30) daye notice in writing, of his intention to exercise
his option to renew this lease prior to the expiration date hereof.
XII. LIABILITY OF LESSOR LIMTED
All property of every kind which may be oa said damised premises
during the term hereof, shall be at the sole risk of Lessee or those
claimtng under It and the Lessor shall not be liable to Lee$ -. or to
soy other person whatsoever, for any injury, loss or damage to any
person or property in or upon said demised premises. Lessee hereby
covenants and agrees to hold Lessor immune from all liability for or

the building and each and every appurtenance thereof and valves defects
therein, and further agrees to hold Lessor harmless from all claims

Lee— shall not be liable for any failure of valor supply, gas supply,
or electric current, or for injury or damage which may be sustained to
person or property by Lasses or any other person caused by or resulting
from steam, electricity, gas, water, rain, fee or by snow or other

or caused by breakage, leakage, obstruction or other defect or pipes,

cause whatsoever, whether the said damage or injury shall be caused by

DIRECTORS'S JOB DESCRIPTION
General Description
Performs responsible professional and administrative work in the field of Early Childhood
Development. Under the direction of the Corpus Christi Council on Early Childhood
Development, the director is responsible for planning and executing a child health,
education and social development program for children ages 0 -4.
Examples of Work Performed
Coordinates and conducts In- Service Training for teachers and aides
Maintains general functional supervision of all programs and activities which are directed
toward meeting needs of children in the field of health, education, and social develop-
ment.
Supervises programs of specialization directed toward prevention of social, psychological,
and educational disorders among children ages 0-4.
Organizes public resources or develops private resources for providing necessary early
childhood development services where such services are not available through existing
public or private institutions.
The Program Director will be responsible for the preparation of future proposals and will
submit some to the Child & Youth Development Council through the Regional Coordinator
for approval.
Performs related work as assigned by the Early Childhood Development Council.
Minimum Qualifications
Education and Experience. The Director must be a graduate from a four -year college
or university with a Master Degree in Education, Public Health, Child or Clinical
Psychology , education with major emphasis closely related subjects.
Two years' professional experience in education, public health, or clinical child psy-
chology, or an equivalent combination of training and experience substituting training
for experience with a maximum substitution of one year.

Knowledge, Skills, and Abilities. Extensive knowledge of coordinating varied, agency
activities with proven or demonstrated administrative capabilities.
Extensive knowledge of techniques and methods of social, psychological, education, and

Social Worker component of the Early Childhood Development Program will
provide social services to children in care and to their families.
Within this project, the Social Worker will insure that parents and
children receive a comprhensive, orderly delivery of services relevant
to the child's and family's needs.
These services will be geared to enhance family strengths, child rear-
ing techniques, and to provide individual counseling to parents when
the child's behavior indicates problematic family relationships or
home conditions.
INTAKE, PROCESS
1. Process all referrals for enrollment.
2. Psycho - social evaluations of each child and family to gather etio-
logical data; to plan for appropriate class placement; and to make
family follow -up contacts.
3. 'Guide the orientation of the child and his parents to entrance into
the center in a manner to provide for maintenance of the family's
dignity and ,privacy.
4. Refer families to alternative community services when the Early
Childhood Development Program is not an appropriate placement.
5. Coordinate efforts of community social service agencies with assess-
ment of the family situation and the most appropriate use of the.early

CONSULTATION
1. Review of the intake psycho - social evaluation to further clarify the child's
and family's environment, along with his classroom behavior and subsequent
learning. These sessions will be carried out in conjunction with the teach-

If a child is absent from the Center because of a contagious or disabling
illness, a doctor's release must be presented before he may return to
the Center. The child must be free from fever for a t anty -four hour
period before he.can return to the Center.
Pedicine: Ann medicine arescribed by a doctor T=st be brought by the
Parent to the Center. The parent must also sign the raedicarion corm
prodded by the Center as medicine cannot be given to a child without
the parent's signature.
Parents will be notified immediately of serious injury or illness of
their child.
Cases of cOa Hlicable diseases by any child will be reported to all parents
or guardians oS children in the Center.
