AN ORDINANCE
CLOSING AND ABANDONING THE 10 -FOOT PIPELINE EASEMENT
ALONG THE NORTH BOUNDARY OF LOT 4, BLOCK +3, GRAY
VILLAGE, AS RECORDED IN VOL. 31, PAGE 46, MAP RECORDS
OF NUECES COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED
HEREINAFTER, SUBJECT TO RELOCATION BY THE ABUTTING
OWNER, TIGER DEVELOPMENT COMPANY, AT ITS OWN EXPENSE,
OF A 4 -INCH GAS LINE INTO THE DEDICATED ALLEY AND
REPAVING THE ALLEY, ALL AS MORE FULLY SET FORTH
HEREAFTER; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 10 -foot pipeline easement along the north-
east boundary line of Lot 4, Block 3, Gray Village, in the City of Corpus
Christi, Nueces County, Texas, of record in Volume 1038, page 277, Deed
Records of Nueces County, Texas, and as shown by replat of the north 1.064
acres of said lot and described as Lot 4B, Block 3, Gray Village; and
WHEREAS, it has been determined that it is feasible'and advantageous
to the City of Corpus Christi to abandon the hereinafter described easement
to the abutting property owners as it is not needed by the City, nor will
it, within the foreseeable future be needed by the City for any purpose
whatsoever:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 -foot pipeline easement situated along
the northeast boundary line of Lot 4, Block 3, Gray Village, in the City
of Corpus Christi, Nueces County, Texas, more particularly described
hereinafter, be and the same is hereby closed for public use and every
municipal purpose and abandoned to the owners of the abutting property,
subject to relocation at the expense of said abutting property owner, Tiger
Development Company, of a 4 -inch gas line into the adjoining dedicated
alley and repaving the alley, in accordance with the laws of the State of
Texas and for the service and interest of the inhabitants of the City of
Corpus Christi:
Being a portion of the pipeline easement along the northeast
line of Lot 4, Block 3, Gray Village, as recorded in Vol. 31,
page 46, Map Records of Nueces County, Texas; said easement
granted to Humble Pipeline Company, recorded in Vol. 1038,
page 277, Nueces County Deed Records, and assigned to the
City of Corpus Christi, Texas, recorded in Vol., 1319, page
249 to 259, Nueces County Deed Records, further described
by metes and bounds as follows:

Beginning at the most northerly corner of said Lot B;
Thence S. 61° 37' 30" E, along the northeast line of
said Lot B, a distance of 280 feet to a point;
Thence S. 290 W. a distance of 10 feet to a point in
southwest line of said pipeline easement;
Thence N. 61° 37' 30" W., along the southwest line of
this pipeline easement, a distance of 233.83 feet to a
point;
Thence N. 490 43' W., along this pipeline easement, a
distance of 47.08 feet to a point in the northwest line
of said Lot 4;
Thence N. 290 E., along the northwest line of said Lot 4,
a distance of 0.28 feet to the place of beginning.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision hereof be given full force and effect for its
purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easement creates
a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, having
requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
