HomeMy WebLinkAbout12576 ORD - 04/02/19751'LM :vp:3 /31/75 1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED CONTRACT WITH THE COUNTY OF NUECES FOR SPONSORSHIP OF THE NUECES COUNTY MENTAL HEALTH -MENTAL RETARDATION PROGRAM, IN SUBSTANTIALLY THE FORM ATTACHED HERETO, MARKED EXHIBIT "A", AND MADE A PART HEREOF; AND DECLAR- ING AN EMERGENCY. WHEREAS, by Ordinance No. 12494, passed and approved by the City Council on February 26, 1975, authorization was given for execution of a Joint contract with the County of Nueces for sponsorship of the Nueces County Mental Health- Mental Retardation Community Center for mental health and mental retardation services under the laws of this State; and WHEREAS, it has been determined by the parties to the aforesaid contract that it would be advantageous to amend said contract to provide that any actions requiring approval of both bodies may be decided at a Joint meeting where the sponsors shall act as a committee of the whole but such action could not obligate either party to the expenditure of money: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the contract authorized by Ordinance No. 12494, passed and approved by the City Council on February 26, 1975, authorizing execution of a Joint contract with the County of Nueces for sponsorship of the Nueces County Mental Health- Mental Retardation program, in substantially the form attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to authorize execution of the aforesaid contract at the earliest practicable date creates a public emergency and an ' imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and 12576 after its passage, IT IS ACCORDINGLY SO ORDAINED, this the Ot day of April, 1975• i MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: DAY OF APRIL, 1975: 4'�4dl tj X Af G*F JN( ty Attorn y MIM:vp:3 /31/75 1st THE STATE OF TEXAS 0 KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES 6 WHEREAS, the County of Nueces and the City of Corpus Christi entered into a joint contract for the purpose of establishing and operating the Nueces County Mental Health- Mental Retardation Community Center for mental health and mental retardation services under the laws of this State; and WHEREAS, it has been determined by the parties to the aforesaid contract that it would be advantageous to amend the said contract: NOW, THEREFORE, BE IT AGREED by the sponsoring agencies, County of Nueces and City of Corpus Christi, that the contract heretofore entered into by and between the parties be and the same is hereby amended by amending paragraph C to hereafter read as follows: "C. REVIEW OF CONTRACT. This contract shall be reviewed annually prior to the beginning of the State's fiscal year and may be renegotiated or amended from time to time as necessary. At least semi - annually the sponsoring agencies may meet jointly to review the community center's activities and finances. Any actions in the contract requiring approval of both bodies may be decided at a joint meeting where the sponsors shall act as a committee of the whole. Each County Commissioner shall have one vote and each Councilman shall have 5/7 of a vote. The majority vote shall be determinative of the approval, provided that no such action shall obligate either party to the expenditure of funds." Except as herein and hereby amended, the terms and conditions of the contract heretofore entered into by the parties hereto shall be and remain in full force and effect. Barnes, County Judge APPROVED: DAY OF APRIL, 1975: County Attorney Corpus Christi, Texas day of , 19 A TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
