I AN ORDINANCE CALLING A RUNOFF ELECTION FOR THE OFFICE OF MAYOR AND COUNCIL MEMBERS IN THE CITY OF CORPUS CHRISTI TO BE HELD ON THE SECOND TUESDAY AFTER THIS CALL OF ELECTION, THE SAME BEING MAY 20, 1975; DESIGNATING PLACES OF HOLDING SUCH ELECTION; NAMING THE OFFICERS THEREFOR; PRESCRIBING THE FORM OF NOTICE OF ELECTION, AND ENACT- ING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the City Charter provides for the holding of a regular City election for Mayor and six (6) Council Members in the City of Corpus Christi on the first Saturday in May in odd - numbered years; and WHEREAS, Article 7.16, Texas Election Code, requires runoff elections in all cities over 200,000 to be held on the second Tuesday follow- ing the issuance of the call for the second election in the event that any candidate for Mayor or Council Member fails to receive a majority of all votes cast for such office at any regular municipal election, at which runoff election the two candidates receiving the highest number of votes for such office in the first election shall again be subject to a vote of the quali- fied voters; and WHEREAS, Article 978a, V.A.C.S., authorizes the governing body of any home rule city to set the time for holding its elections; and WHEREAS, the official canvass of the election returns of the regular election duly held for the office of Mayor and Council Members has been duly had in accordance with State law and City Charter requirements, and inasmuch as none of the candidates for the office of Mayor and none of the candidates for office of Council Member in Places 1, 3, 4 and 5 received a majority of all votes cast at the said regular election, held on May 3, 1975, for such office, there is hereby declared a necessity for a runoff election: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a runoff election for the selection of Mayor and Council Members in Places 1, 3, 4 and 5, in the City of Corpus Christi, shall be held in the City of Corpus Christi on May 20, 1975, with the names of the following candidates to appear on said ballot for the respective offices as follows: 12610 MAYOR: Luther G. Rodriguez COUNCIL MEMBER PLACE 3: Rogerio Lopez Gabe Lozano, Sr. COUNCIL MEMBER PLACE 4: Mrs. Edith Coffey Bill Tipton COUNCIL MEMBER PLACE 5: Edward L. Sample Ricardo Gonzalez SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. That the names of the candidates for the offices of Mayor and City Council Members for the respective places shall be placed on said ballot in the manner and form prescribed by law. SECTION 4. Absentee voting shall be conducted by the City Secretary at his office in the City Hall, and the results canvassed and returns made as is provided by law. For the purposes of this runoff election the office of the City Secretary is declared to specifically include that area in the City of Corpus Christi City Hall on the first floor in the lobby in front of the Building Division Information Desk and the hours for conducting such'absentee voting shall be as follows, with absentee voting to commence on May 8, 1975, and extending through Friday, May 16, 1975, including Saturday, May 10, 1975, but excluding Sunday, May 11, 1975: May 8 and May 9, 1975, from 8:00 A.M. to 5:00 P.M. May 10, 1975, from 2:00 P.M. to 8:00 P.M. May 12 and May 13, 1975, from 8:00 A.M. to 5:00 P.M. May 14 and May 15, 1975, from 8:00 A.M. to 7:00 P.M. May 16, 1975, from 8:00 A.M. to 5:00 P.M. A substantial copy of this ordinance, signed by the Mayor of the City of Corpus Christi, attested by the City Secretary, shall constitute due notice of said general election, and the Mayor is hereby ' authorized and directed to cause a copy of this ordinance signed by him to be posted at the City Hall and each of the voting places in each of the elec- tion precincts prior to said election, and to cause a copy of this ordinance signed by him to be published in the Corpus Christi Times, the official newspaper, being a newspaper in general circulation published in the City of Corpus Christi, said publication to be made as soon as practicable after passage of this ordinance and to be made on two separate occasions. SECTION 6. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertain- ing to municipal affairs and that the notice of such runoff election should be promptly posted and that a regular city runoff election for the election of the Mayor and Council Members for Places 1, 3, 4 and 5 in the City of Corpus Christi shall be held on the second Tuesday after this call creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage,'IT IS ACCORDINGLY SO ORDAINED, this the 7th day of May, 1975.
