HomeMy WebLinkAbout12613 ORD - 05/14/1975RWC: e:hb :5/-12/75: lst AN ORDINANCE CLOSING AND ABANDONING THE EXISTING UTILITY EASE- MENTS LOCATED IN LOTS 2 -R THROUGH 7 -R AND 8 THROUGH 40, BLOCK 1, MID -TOWN INDUSTRIAL DISTRICT, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE REPLATTING OF THESE LOTS AND THE DEDICATION OF ACCEPTABLE ALTERNATE EASEMENTS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists certain utility easements in Lots 2 -R through 7 -R and 8 through 40, Block 1, Mid -Town Industrial District, as recorded in Volume 31, Page 8 and Volume 29, Page 58, Map Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon these easements subject to the replatting of these lots and the dedication of acceptable alternate utility easements: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the utility easements located in Lots 2 -R through 7 -R and 8 through 40, Block 1, Mid -Town Industrial District, as recorded in Volume 31, Page 8, and Volume 29, Page 58, Map Records of Nueces County, Texas, be and the same are hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property, in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas, subject to the replatting of these lots and the dedication of acceptable alternate easements. SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, or provision of this ordinance shall be held invalid by final judgment of a court of competent jurisdiction, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a 12613 public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the4day of May, 1975.
