HomeMy WebLinkAbout12632 ORD - 06/04/1975MLM:VMR :6- 4- 75;lST t AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE OFFICE OF THE GOVERNOR, DIVISION OF PLANNING COORDINATION, FOR AN INTERNSHIP PROGRAM, ALL AS MARE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO ENTER INTO AN AGREEMENT WITH THE OFFICE OF THE GOVERNOR, DIVISION OF PLANNING COORDINATION, FOR AN INTERNSHIP PROGRAM, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ". SECTION 2. CONTRACTING PARTIES The Receiving Aeency: Office of the Governor, Division of Planning Coordination, hereinafter referred to as PLANNING AGENCY. The Performing Contractor: The City of Corpus Christi II. CONTRACT DOMIENTS: This Contracting Document constitutes the entire agreement between the PLANNING AGENCY AND THE CONTRACTOR. III. STATa1ENT OF SERVICES TO BE PERFORMED: - - WHEREAS, the PLANNING AGENCY desires to engage the CONTRACTOR to render certain technical and professional services, NOW,, THEREFORE,_the parties hereto do mutually agree as follows: A. Employment of Contractor: 'The PLAN IN AGENCY agrees to engage the CONTRACTOR and the CONTRACTOR hereby agrees to perform the services hereinafter set forth in connection with the Governor's Public Service Intern Program, CETA Pilot Project, for one (1) year to begin on or. about June 1, 1975, and to continue through the end of the Spring - 1976 college semester. B.. Scope of Services: The CONTRACTOR will do, perform. and personally carry out the services stated below: 1. The CONTRACTOR will supervise the project which the CONTRACTOR's intern is conducting. 2. -*The CONTRACTOR will work with the faculty advisor and the PLANNING AGENCY throughout the Program. Specifically, the CONTRACTOR will participate in meetings c7ith the interns, representatives of the PLANNING AGENCY, and the faculty advisor when necessary. Through this cooperative effort, the intern serving with the CONTRACTOR will be able to derive the maximum benefit from this educational and work experience. 3. The CONTRACTOR will submit to the PLANNING AGENCY an evaluation of the work product of the intern as well as the internship generally. 4. The CONTRACTOR will pay the interns the appropriate amount for the intern's work. These amounts are as follows: During the Summer 1975 semester, the intern shall work for eleven (11) weeks at thirty (30) hours per week and shall be paid a total of twelve hundred dollars ($1,200.00) for the 11 week period. During the Fall 1975 or Spring 1976 semesters, the intern shall work fourteen (14) weeks at twenty (20) hours per week and shall be paid a total pf one thousand dollars ($1,000.00) for the 14 week period. These amounts will be paid to She intern on a mutually agreeable schedule to be arranged between the intern and the CONTRACTOR. The CONTRACTOR shall determine the start and stop dates within each semester. 5. The CONTRACTOR will pay travel expenses for the intern to attc•. ^.d an Orientation Conference in Austin. The Conference will be held to orient interns to the scope and philosophy of the intern project. A Conference will be held at the beginning of each semester. 6. The CONTRACTOR will supervise the intern in producing a final report which describes the intern's project. The CONTRACTOR will insure that the receiving agency is provided three (3) copies of that report. 7. The CONTRACTOR will pay all travel expenses incurred by the intern and approved in advance by the CONTRACTOR during the contract period: Expenses will be calculated under the normal' policies of the CONTRACTOR. 8. The CONTRACTOR will nay for the costs of printing, supplies, rent,- and any other expenses which are approved by the CONTRACTOR and which are necessary for the successful and timely completion of the intern's work project. C. Qualifications of Interns: Interns will be chosen from "economically -' disadvantaged" students currently enrolled in Texas institutions of higher education. ."Economically disadvantaged" shall mean a person who is a member of a family: 1. Which receives cash welfare payments; or 2. Whose annual income in relation to family size does not exceed the poverty level determined in accordance with criteria established by the Office of Management and Budget (OMB). D. Allocation of Internships: Each prime sponsor will receive one (1)- _ intern per semester for one (1) calendar -year for a total of three - " '(3) interns per year. 'IV. COMPENSATION: The PLANNING AGENCY will pay the CONTRACTOR twelve hundred dollars ($1,200.00) during the Summer 1975 semester; and one thousand dollars ($1,000.00) during the Fall 1975 semester; and one thousand dollars ($1,000.00) during the Spring 1976 semester for a total of not more than $3,200.00. These funds will be reimbursable monthly or as requested by the prime sponsor. In the event that 'an intern resigns his position before the end of the semester, the CONTRACTOR will pay an amount of money to the intern which will be determined by applying a percentage to the appropriate stipend, which-is equal to the percentage of the semester in -which the intern participated. V. AMENDMENT OF CONTRACT: The PLANNING AGENCY and CONTRACTOR agree that the scope of services, amount of compensation, method of payment, and other provisions of this contract, may be amended or modified in writing with the mutual written agreement of both parties. Any such amendments or modifications shall be attached to the contract documents and shall constitute a part of the total agree- ment between the parties. IN WITNESS WHEREOF, the PLANNING AGENCY and CONTRACTOR have executed this agreement as of the date first above written.
