AN ORDINANCE
CLOSING AND ABANDONING THE WEST THREE FEET OF AN
EXISTING 10 -FOOT UTILITY EASEMENT OUT OF LOTS 10
& 11, BLOCK 7, WESTERN HILLS UNIT 02, AS RECORDED
IN VOLUME 38, PAGE 10, MAP RECORDS OF NUECES COUNTY,
TEXAS, SUBJECT TO THE DEDICATION OF AN ALTERNATE
THREE FEET ADJACENT TO THE EAST SIDE OF THE EXISTING
EASEMENT BY REPLATTING; PROVIDING FOR SEVERABILITY;
AND DECLARING AN EMERGENCY.
WHEREAS, there exists a ten foot utility easement in Lots 10
& 11, Block 7, Western Hills Unit #2, in the City of Corpus Christi, Nueces
County, Texas, as-recorded in Volume 38, Page 10, of the Map Records of
Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advan-
tageous to the City of Corpus Christi to abandon the West three feet of
said utility easement, which three feet is more fully hereinafter set out
by metes and bounds, subject to the dedication of an acceptable alternate
three feet adjacent to the east side of the existing easement, by replatting:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the West three feet of an existing ten -foot
utility easement in Lots 10 & 11, Block 7, Western Hills Unit #2, in the City
of Corpus Christi, Nueces County, Texas, as recorded in Volume 38, Page 10,
of the Map Records of Nueces County, Texas, which three feet is described
as follows:
BEGINNING at a point on the southwest right -of -way line of
Chamizal Street, for the east corner of this easement and
POINT OF BEGINNING, from which point the east corner of
Lot 11, Block 7, of Western Hills Unit #2, bears South 50°
55' 30" East, 2.0 feet;
THENCE South 39° 04' 30" West, 2.0 feet from and parallel to
the Southeast boundary line of said Lot 11, Block 7, 115.0 feet
to the South corner of this easement;
THENCE North 50° 55' 30" West, 10.0 feet from and parallel
to the Southwest boundary line of said Lot 11, Block 7,
3.0 feet to the West corner of this easement;
THENCE North 39° 04' 30" East, 115.0 feet to a point on
said Southwest right -of -sway line, for the North corner of
this easement;
THENCE South 50° 55' 30" East with said right -of -way line,
3.0 feet to the point of BEGINNING;

be and the same is hereby closed for public use and every municipal purpose
and abandoned to the owners of the abutting property, in accordance with the
laws of the State of Texas, and for the service and interest of the inhabit-
ants of the City of Corpus Christi, Texas, subject to the dedication of an
acceptable alternate three feet adjacent to the east side of the existing
easement, by replatting.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, or provision of this ordinance shall be held invalid by
final judgment of a court of competent jurisdiction, it shall not affect
any valid provisions of this or any other ordinance of the City of Corpus.:
Christi to which these rules and regulations relate.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easement and the
dedication of an acceptable alternate three feet, creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date of
its introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor, having declared such
emergency and necessity to exist, having requested the suspension of the
Charter rule and that this ordinance take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED THIS THE

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
