BRADSHAW AND BURLEY FELLOWS AND WIFE, SHIRLEY FELLOWS, FOR THE CALALLEN TRUNK MAIN - UPRIVER ROAD TO SHARPSBURG ROAD PROJECT, NO. 250 -72 -5; APPROPRIATING $2325 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, OF WHICH SUM $325 IS FOR ACQUISITION OF EASEMENT FROM JOHN H. BRADSHAW AND THE SUM OF $2000 FOR ACQUISITION FROM BURLEY FELLOWS AND WIFE; AND DECLARING AN EMERGENCY. O BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to accept the following utility easements from the following property owners: Being a 15 foot wide strip of land for utility easement out of Westbrook Heights Annex, Tract 5, as recorded in Volume 31, Page 74, bap Records of Nueces County, Texas, more particularly described by metes and bounds as follows: Beginning at a point in the South line of said Tract 5 from which the Southeast corner of said tract 5 bears S. 860 10' E., 302.02 feet; Thence N. 860 10' W., alcug said South line of Tract 5, a distance of 15.55 feet to a point; Thence N. 190 05' E., 389.25 feet to a point in the North line of Tract 5; Thence S. 730 54' E., with the North line of Tract 5, a distance of 15.02 feet to a point; Thence S. 190 05' W., a distance of 385.95 feet to the point of beginning. Containing 0.133 acres more or less. Together with a 50 foot wide temporary construction easement parallel to and abutting the East line of the above described utility easement to be used for the storage and operating of materials and equipment used to construct a sanitary sewer line within the said utility easement. Said temporary construction easements to expire six (6) months after completion of the pro- ject for which these easements were -granted. owned by John F. Bradshaw, and Being a 15 foot wide strip of land running generally North and South with a 15 foot wide branch extending Westerly, for a utility easement, out of Westbrook Heights Annex, Tract 6, as recorded in Volume 30, Page 10, Map Records of Nueces County, Texas, more particularly described by metes and bounds as follows: Beginning at a point in the South boundary line of said Tract 6 from which the Sotheast corner of said Tract 6 in the Missouri Pacific Railraod West right of way line, bears S. 730 54' E., 263.02 feet; 12GG2 0 Thence N. 730 54' W., with said South right of way line of Tract 6, a distance of 15.02 feet to a point; Thence N. 190 05' E., 245 feet to a point; Thence N. 70 04' E., 202.75 feet to a point; Thence N. 220 14' E., 416.08 feet to a point; Thence S. 890 01' W., 556.83 feet to a point; Thence N. 720 29' W., 12.69 feet to a point in the most North- erly Northwest line of Tract 6; Thence N-340 33' E., with said Northwest line of Tract 6, 15.69 feet to a point; Thence S. 720 29' E , 5.91 feet to a point; Thence N. 890 O1' E., 559.65 -feet to a point; Thence N. 140 02' E., 585.25 feet to a point in the Southwest line of a 200 foot wide strip of land off the North end of said Tract 6 previously purchased by the City of Corpus Christi; Thence S. 540 47' E., with the Southwest line of said 200 foot strip, 16.09 feet to a point; Thence S. 140 02' W., 585.93 feet to a point; Thence S. 220 14' W , 425.50 feet to a point; Thence S. 70 04' W., 202.25 feet to a point; Thence S. 190 02' W., 245.80 feet to the point of beginning. Containing 0.824 acres more or less. Together with a 50 foot wide temporary construction easement, parallel to and immediately East of the North -South utility easement'strip and a 25 foot wide temporary construction ease- ment parallel to and adjacent to and each side of the Westerly branch utility easement strip. This temporary construction easement is to be used for storage and operating of materials and equipment to construct a sanitary sewer within the utility easement. Said temporary construction easements to expire six (6) months after completion of the project for which these easements were granted. owned by Burley Fellows and Wife, Shirley Fellows, for the Calallen Trunk Main - UpRiver Road to Sharpsburg Road, Project No. 250 -72 -5. SECTION 2. There is hereby appropriated the sum of $2325 out of the No. 250 Sanitary Sewer Bond Fund, of which $325 is for acquisition of the aforesaid easement from John Bradshaw and the sum of $2000 is for acquisition of the aforesaid easement from Burley Fellows and wife, Shirley Fellows. -2- SECTION 3. The necessity to authorize acquisition of the aforesaid easements in order that the project may continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this thee2r� of June, 1975.
