CITY OF CORPUS CHRISTI
On this the 25th day of June, 1975, the City Council
of the City of Corpus Christi, Texas, convened in Regular
Meeting, with the following members of said Council present,
to -wit:
Jason Luby, Mayor
Dr. Bill Tipton,
Eduardo de Ases,
Ruth Gill, Commissioners,
Bob Gulley,
Gabe Lozano, Sr.,
Edward L. Sample,
Bill G. Read, City Secretary,
with the following absent: `%/Jih2c2�
constituting a quorum, at which time the following among other
business was transacted:
Mayor Jason Luby presented for the consideration of
the Council an ordinance. The ordinance was read by the City
Secretary. The Mayor presented to the Council, a communica-
tion in writing pertaining to said proposed ordinance, as
follows:

"TO THE MEMBERS OF THE CITY COUNCIL
Corpus Christi, Texas
"For the reasons set forth in the emergency clause
of the foregoing ordinance, a public emergency and imperative
public necessity exist for the suspension of the Charter rule
or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance
or resolution shall be read at three meetings of the City
Council; I, therefore, request that you suspend said Charter
rule or requirement and pass this ordinance finally on the

date it is introduced, or at the present meeting of the City.

Charter provision prohibiting ordinances from being passed
finally on the date introduced be suspended for the reasons
stated in the written - request of the Mayor and stated in the
emergency clause of the ordinance.,,The motion was seconded
by Commissioner • The motion was carried
by an unanimous vote by the City Council, viz:
AYES: Commissioners Tipton, de Ases, Gill, Gulley,
Lozano, and Sample.
NAYS: None.
The Mayor requested that the records show that he
voted Aye. This was done.

The Mayor announced that the ordinance had been

ORDINANCE NO.- 1.26655
BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTEN-
TION TO ISSUE CERTIFICATES OF OBLIGATION; AND
ORDAINING OTHER MATTERS RELATING TO THE SUBJECT;
AND DECLARING AN EMERGENCY.
t; WHEREAS, it is hereby officially found and determined:
that a-case of emergency or urgent public necessity exists which
requires the holding of the meeting at which this ordinance is
passed; such•emergency or urgent public necessity being that
the publication of>Notice of,Intention to Issue Certificates
of Obligation to provide proceeds for the acquisition of a
public utility, -to -wit: Areas 1 and 2 of the Corpus Christi
Municipal Gas Corporation, is required as soon as possible and
without delay for necessary and urgently needed public improve -
ments;- and that said'meeting was open to the public, and public
notice`of -the time, place, -and purpose of said meeting was
given, all asrequired- by,,Vernon's Ann. Civ. St.Art. 6252 -17,
as amended.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That attached hereto and marked "Exhibit
A "'is a form of notice, the form and substance of which are
hereby passed and approved.
SECTION 21 That the City Manager shall cause said
notice to be published, in substantially the form attached
hereto, in the Corpus Christi Times, a newspaper of general
circulation in the City of Corpus Christi, Texas, for two
consecutive weeks, the date of the first publication to be
June 25, 1975, which date is at least fourteen (14) days prior
to the day tentatively proposed for authorizing the issuance
of the Certificates of Obligation as shown in said notice.
SECTION 3. The fact that the acquisition of a public
utility, viz.,Areas 1 and 2 of the Corpus Christi Municipal
Gas Corporation, is necessary for the orderly development and
growth of the City of Corpus Christi, Texas, creates a public
emergency and an imperative public necessity requiring the
suspension of the Charter rule providing that no ordinance or
resolution shall be passed finally on the date it is introduced
and that such ordinance or resolution shall be read at three
several meetings of the City Council and the Mayor having
declared that such public emergency and imperative necessity
exist, and having requested that said Charter rule be suspended
and that this ordinance take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
SECTION 4. That all ordinances and resolutions or
parts thereof in conflict herewith are hereby repealed.

NOTICE OFrINTENTION TO ISSUE CERTIFICATES
4 i OF OBLIGATION
`Y NOTICE IS HEREBY GIVEN that it is the intention of
the City Council of the City of Cprpus Christi to issue the
interest- bearing ,Certificates of Obligation of the City for`
the,purpose of purchasing an existing utility system and rights
of way"'for'authorized needs and purposes, viz., Areas 1 and
2 of the,Corpus Christi ~Municipal Gas Corporation in said

City, and for the payment of contract obligations and for-
-
professional services (including attorney's, financial
advisor's and auditing fees). The City Council tentatively
proposes to authorize the issuance of said Certificates of
Obligation at its regular meeting place in the City Hall at
a special meeting to commence at 11:00 o'clock, A.M., on the
9th day o£ July, 1975• The maximum amount of Certificates of
Obligation indebtedness that may be authorized for such pur-
pose is $2,000,000. The City Council presently proposes to
provide for payment of such certificates by the levy of taxes.

I, the undersigned, City Secretary of the City of
Corpus Christi, Texas, do hereby certify that the above and
foregoing is a true, full and correct copy of Ordinance
No.jU L5 , passed by the City Council of the City of
Corpus Christi, Texas, (and of the minutes pertaining thereto)
on the 25th day of June, 1975, directing the publication of
Notice of Intention to issue Certificates of Obligation,
which ordinance is duly of record in the minutes of said City
Council, and said meeting was open to the public as required
by law and public notice of the time, place, and purpose of
said meeting was given as required by Vernon's Ann. Civ. Stat.
Art. 6252 -17, as amended.
EXECUTED UNDER MY HAND AND SEAL OF SAID CITY, this
