HomeMy WebLinkAbout12716 ORD - 07/30/1975JKH:hb:7 /28/75:ist T O AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF TIM CLOWER, TRUSTEE, BY GRANTING A SPECIAL COUNCIL PERMIT FOR AN APARTMENT COMPLEX ACCORDING TO THE SITE PLAN APPROVED BY THE PLANNING COMMISSION, SUBJECT TO THE CONDITIONS HEREINAFTER SET FORTH, ON 1.9 ACRES OF LAND, MORE OR LESS, OUT OF LOT 1, SECTION I, PAISLEY SUBDIVISION OF THE HOFFMAN TRACT, MORE PAR- TICULARLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tim Clower, Trustee for amendment to the Zoning Map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, July 2, 1975, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, at seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 1 116 0 6 SECTION 2. That a Special Council Permit be granted on 1.9 acres of land, more or less, out of Lot 1, Section I. Paisley Subdivision of the Hoffman Tract, situated in the City of Corpus Christi, Nueces County, Texas, more particularly described hereinafter, according to the site plan approved by the Planning Commission attached hereto and made a part hereof, marked Exhibit "A ", subject to all other conditions of "A -1" Apartment House District, and further subject to the following conditions: as follows: 1. That the property to the west of this tract or parcel presently zoned "B -4" General Business District, be developed concurrently with the area included within this special permit; 2. That a new 8 -foot concrete and cedar fence be constructed between the area of this request and Pope Place f5 Subdivision, according to the standards attached hereto and marked Exhibits "B-1" and "B -2 "; 3. That there shall be no structures built within an area 50 feet west of the division line between the area of application and Pope Place #5 Subdivision; and 4. That there shall be no window openings on the east surface of such structures opposite Pope Place #5 Subdivision The 1.9 acres, more or less is more particularly described Being a tract or parcel of land consisting of 1.9 acres, more or less situated in lot 1, Section I, Paisley Sub- division of the Hoffman Tract in Nueces County, Texas: BEGINNING at the east or northeast corner of Carmel Village as shown by map filed in Volume 26, Page 33 of the map records of said county for the north corner and POINT OF BEGINNING of this tract; THENCE with the projection of the northeast boundary line of Carmel Village S 330 47' E 500 feet, more or less, to the east corner of this tract, same corner being the north corner of Paisley Tract as recorded in Volume 21, Page 41 of said map records; THENCE with the westerly boundary line of Paisley Place S 310 53' W 200 feet, more or less, to the south corner of this tract; THENCE N 33° 47' W 480 feet, more or less, to a point in the southeast boundary line of said Carmel Village for the west corner of this tract; THENCE with said boundary line N 28° 50' E 200 feet, more or less, to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the property included in the Special Permit herein granted, other than the one specified -2- C� O In this Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official Zoning Map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and aft r its passage, IT IS ACCORDINGLY SO ORDAINED, this the 30 y of 1975.
