AN ORDINANCE
AUTHORIZING ACCEPTANCE OF TEXAS HIGHWAY COMMISSION
MINUTE ORDERS PERTAINING TO JOINT CONSTRUCTION OF
STREET IMPROVEMENTS IN THE CITY OF CORPUS CHRISTI BY
THE CITY AND THE STATE DEPARTMENT OF HIGHWAYS AND
.PUBLIC TRANSPORTATION, AS MORE FULLY SET OUT IN SAID
MINUTE ORDERS, A COPY OF EACH BEING ATTACHED, MARKED
EXHIBITS "A" THROUGH "G "; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY"OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he hereby is, authorized
to accept, for and on behalf of the City of Corpus Christi, Texas Highway
Commission Minute Orders Nos. 70319 through 70325, inclusive, for improve-
ment of the following named streets under the Urban Systems Program:
Minute Order # Location
70319 Port Avenue from Agnes Street to Morgan Street;
70320 Port Avenue from Morgan Street to S.H. 286;
70321 Port Avenue from S.H. 286 to Ayers;
70322 Kostoryz Road from Padre Island Dr. to Holly Road;
70323 Coopers Alley from Tancahua to Mesquite Street;
70324 Nueces Bay Boulevard from I.H. 37 to W. Broadway;
70325 McKenzie Road from Loop 407 to I.H. 37;
a copy of said Minute Orders, marked Exhibits "A" through "G ", being attached
hereto and made a part hereof for all pertinent purposes. The improvement
of these streets, located in the City of Corpus Christi, is to be jointly
performed by the City and the State Department of Highways and Public
Transportation.
SECTION 2. The necessity to authorize the acceptance of the afore-
mentioned Minute Orders so that plans and construction may be commenced at
the earliest possible date, creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but

that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take

struction on Port Avenue from Agnes Street to Morgan Street, a distance of approximately
0.6 mile; and

to assist the City of Corpus Christi in such work;
NOW, THEREFORE, the Engineer- Director is directed to tender the following proposal to the
City of-Corpus Christi:
Provided the City will:
1. Conform to the State Department of Highways and Public Transportation policies and
regulations regarding utility adjustments and construction responsibility.
2. Maintain all of the work constructed as part of the project and agree to regulate
traffic, provide for parallel parking and prevent encroachment on the right of
way, all in accordance with governing policies and-regulations of the Department.
Subject to the availability of Federal -aid Urban System funds and the eligibility of the
proposed work .for financing with said funds, the State Department of Highways and Public
Transportation will:
1. Prepare construction plans and specifications.

cost of $76,100 as authorized in the 1975 -1976 Urban System Program,
Upon acceptance of the provisions of this Order by the appropriate officials of the City
of Corpus Christi, IT IS ORDERED that Port Avenue extending from Agnes Street to Morgan LI-
Street, a'distance of approximately 0.6 mile, be and is hereby designated as a ,ATP. 0?O

with the City covering -the details of the proposed improvements, to proceed with the on-
gineering development of the project and after the City has fulfilled its responsibili-
ties, to proceed with construction as authorized herein in the most feasible and economi-

It is understood that the City may discharge its construction obligations as outlined
herein in any manner as it may elect. 'In the event the City desires the State to include

This Order shall become operative upon acceptance by the City of Corpus Christi and if not

Program.
Upon acceptance of the provisions of this order by the appropriate officials of the

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
