AN ORDINANCE
AMENDING SUBSECTION 6.32 OF THE LAND DRILLING ORDINANCE,
NO. 8879, BY AMENDING ITEM 4'OF-PARAGRAPH F SO AS TO PERMIT
RENEWAL OF "IN LIEU OF PLUGGING" BONDS ONLY FOR THOSE WELLS
WHICH HAVE STILL HOLDS NATVALID LEASE EONA THE AMINERALSS UNDERLYING THE
SURFACE WHERE SUCH WELL IS LOCATED, AND TO PROVIDE THE
PETROLEUM INSPECTION DIVISION WITH EVIDENCE THAT HE DOES
IN FACT OWN OR CONTROL THE MINERALS UNDERLYING THAT WELL;
FURTHER PROVIDING THAT WHERE THE MINERALS LEASE HAS EXPIRED
AND WELLS HAVE NOT BEEN PLUGGED THAT THE OPERATOR AND THE
SURETY WILL BE NOTIFIED PRIOR TO EXPIRATION OF THE BOND TO
INSURE SUFFICIENT TIME FOR PROPER AND ADEQUATE PLUGGING AND
ABANDONMENT OF'WELL; PROVIDING FOR PUBLICATION; PROVIDING
FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Land Drilling Ordinance,No. 8879, as amended,
be amended by amending Subsection 6.32 thereof by amending item 4 of paragraph
F by adding a new paragraph thereto, reading as follows:
"Renewal of 'in lieu of plugging' bonds shall be permitted only
for those wells which have not been plugged and abandoned where the operator
and principal on the bond still holds a valid lease on the minerals underlying
the surface where such well is located. The operator, when posting a renewal
of the bond, shall also provide the Petroleum Inspection Division with evidence
that he does in fact own or control the minerals underlying that well. In
cases where the mineral lease has expired and wells have not been plugged,
then the operator and the surety will be notified at least three (3) months
prior to the expiration of the bond so that sufficient time will be permitted
for the operator or surety to adequately plug and abandon the well or the
City will in fact plug and abandon the well and charge the cost to the
surety."
SECTION 2. Publication shall be made one time in the official
publication of the City of Corpus Christi, after final passage, which publica-
tion shall contain the caption stating in substance the purpose of the
ordinance.
SECTION 3. If for any reason any section, paragraph, subdivision, '
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause, phrase,

word, or provision of this ordinance, for it is the definite intent of this
City= Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its purpose.
