AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF WALDRON
ROAD STREET IMPROVEMENTS (STORM SEWER OUTFALL
PROJECT); APPROPRIATING A TOTAL OF $305,506.42,
OF WHICH $127,506.42 IS OUT OF THE NO. 295
STORM SEWER BOND FUND, $125,034.20 BEING FOR
THE CONSTRUCTION AND $2,472.22 BEING FOR INCI-
DENTAL AND RELATED EXPENSES, ALL APPLICABLE TO
PROJECT NO. 295 -72 -10.1, AND $178,600 IS OUT
OF THE NO. 220 STREET BOND FUND, $170,653.90
BEING FOR THE CONSTRUCTION CONTRACT AND $7,346.10
BEING FOR INCIDENTAL AND RELATED EXPENSES, ALL
APPLICABLE TO PROJECT NO. 220 -72 -7; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. _That the City Manager be and he is hereby
authorized to execute a contract with Heldenfels Brothers for
construction of Waldron Road Street Improvements (Storm Sewer
Outfall Project), all as is more fully described in the plans
and specifications and contract documents on file in the office
of the City Secretary, all of which are made a part hereof by
reference and according to the bid of Heldenfels Brothers, opened
on the 10th day of September, 1975, said bid of Heldenfels Brothers
being the lowest and most advantageous to the City of Corpus
Christi.
SECTION 2. There is hereby appropriated a total of
$305,506.42, of which $127,506.42 is out of the No. 295 Storm
Sewer Bond Fund, $125,034.20 being for the construction and
$2,472.22 being for incidental and related expenses, all applicable
to Project No. 295 -72 -10.1, and $178,000 is out of the No. 220
Street Bond Fund, $170,653.90 being for the construction contract
and $7,346.10 being for incidental and related expenses, all
applicable to Project No. 220 -72 -7.
SECTION 3. The necessity to execute the aforesaid
contract and to appropriate the sums hereinabove set out at the
earliest possible date so that construction may be commenced without
delay creates a public emergency and an imperative public necessity

requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at
three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance
take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED, this the day of
September, 1975.
