CARROLL, AND ROLLO RAGLE AND WIFE, VERA RAGLE, OF DRAINAGE AND UTILITY EASEMENTS IN CONNECTION WITH THE KINGSBURY DRIVE LATERAL EXTENSION, PROJECT NO. 250- 72 -7.3; APPROPRIATING OUT OF THE NO. 250 SANITARY SEWER BOND FUND $330, OF WHICH $180 IS FOR ACQUISITION OF EASEMENT FROM JOHN E. CARROLL AND WIFE AND $150 FOR ACQUISITION OF EASEMENT FROM ROLLO RAGLE AND WIFE; AND DECLARING AN EMERGENCY. • BE.IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That authorization is hereby given for acceptance by the City of Corpus Christi from John E. Carroll and +.rife, Judy C. Carroll, and Rollo Ragle and wife, Vera Ragle, of the following described drainage and utility easements for the Kingsbury Drive Lateral Extension, Project No. 250- 72 -7.3: Parcel Number 1 John E. Carroll Being a 15.0 foot wide strip of land for sanitary sewer easement lying West of, parallel and adjacent to the Easterly boundary line of Lot 4, Block 15, Highway Village, Section 3, as shown by map 'Of record in Volume 13, Page 24, Map Records, Nueces County, Texas, and more par- ticularly described by metes and bounds as follows- Beginning at a point on the Northerly right -of -way line of Kingsbury Drive which bears S. 840 03' E., a distance of 65 -1 feet from the South- west corner of Lot 4, Block 157 Highway Village, Section 39 said point being the Southeast corner of said Lot 4,•for the beginning pbint of this tract; Thence N. 370 57' E., along the Easterly boundary line of said Lot 4, s distance of 22.0 feet, more or less, to a point; Thence N. 610 53' E., along the Easterly boundary line of said Lot 4, s distance of 158.6 feet to a point; Thence N. 240 221 E., along the Easterly boundary line of said Lot 4,-a distance of 331.9 Peet to a point; Thence N. 040 58* E -� along the Easterly boundaxy line of said Lot 4, a distance of 30.0 feet, more or less to a point which is the Northeast corner of said Lot 4, and the Northeast corner of the aforementioned 15.0 foot wide easement. Together with a 35.0 foot wide temporary construction easement to be used for working room, storage. of materials.and equipment, along the Westerly side of the above described sanitary sewer easement_ Said temporary construction easement shall be abandoned six (6) months after completion of the project for which the sanitary sewer easement is required. Permanent easement contains 5,167.50 square feet, more or less. 12839 Parcel Number 2 Rollo Ragle Being a 15.0 foot wide strip of land for sanitary sewer easement lying East of, parallel and adjacent to the Westerly boundary line of Lot 1, Block 16, Highway Village, Section 3, as shown by map of record-in Volume 13, Page 24, Map Records, Nueces Ccunty, Texas, and more parti- culesly described by metes and bounds as follows: Beginnnn at a point on the Southerly boundary line of Lot 1, Block 16, Highway Village, Section 3, said point being the common corner of Lot 3, Block 14, Lot 4, Bloch 15, Lot 1 and Lot 5, Block 16, of said Highway Village, for the beginning and Soutwest corner of this tract; Thence N. 040 58' E., along the Wester3y boundary -line of said* Lot 13 a distance of 15.5 -feet, more or less, to s point; Thence N. 290 26' E., along the Westerly boundary line of said Lot'l, a distance of 87_0 feet to a point; Thence N. 260 54, E., along the Westerly boundary line of said Lot 1, a distance of 47.8 feet to a point; Thence N. 060 43' E., along the Westerly boundary line of said Lot 1, a distance of 53.7 feet to a point; Thence N. 320 03, E.; along the Westerly boundary line of said Lot 1, a distance of 55.4 feet to a point which i.s the Northwest corner of said Lot 1, Block -16, and the Northeast corner of said Lot 3, Block 14, said Point being the Northwest corner of the aforementioned 15.0 foot wide easement. .Together with a 35.0 foot wide temporary construction easement, to be used for working room, storage of materials and equipment, along the Westerly side of the above described sanitary sewer easement. Permanent easement contains 4,021.0 square feet, more or less. SECTION 2. There is hereby appropriated out of the No. 250 Sanitary Sewer Bond Fund the sum of $330 for acquisition of the aforesaid drainage and utility easements. SECTION 3. The necessity to appropriate the sums hereinabove described and authorizing the acceptance by the City of Corpus Christi of the described drainage and utility easements in connection with the Kingsbury Drive Lateral Extension Project in order that the project may continue with- out delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City -2- Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in Rill force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the T day of October, 1975.
