AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
ABACUS CORPORATION FOR CONSTRUCTION OF THE CLARRWOOD,
SAN JOAN, AND MC NORTON SANITARY SEWER (E.P.A. #WPC -TEX-
899), SUBJECT TO CONCURRENCE FROM THE TEXAS WATER QUALITY
BOARD AND THE ENVIRONMENTAL PROTECTION AGENCY; APPROPRIATING
$425,000 OUT OF THE NO. 250 SANITARY SEWER BOND FOND, OF
WHICH $404,345 IS FOR THE CONSTRUCTION CONTRACT AND $20,655
IS FOR INCIDENTAL AND RELATED EXPENSES, ALL APPLICABLE TO
PROJECT NO. 250 -70 -105; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized to
execute, for and on behalf of the City of Corpus Christi, a contract with Abacus
Corporation for construction of the Clarkwood, San Juan, and McNorton Sanitary
Sewer (EPA $WPC -TES -899), all as is more fully described in the plans and
specifications and contract documents on file in the office of the City Secre-
tary, all of which are made a part hereof by reference and according to the
bid of Abacus Corporation, opened on the 15th day of October, 1975, said bid
being the lowest and most advantageous to the City of Corpus Christi, and being
subject to concurrence from the Texas Water Quality Board and the Environmental
Protection Agency.
SECTION 2. That there is hereby appropriated the sum of $425,000 out
of the No. 250 Sanitary Sewer Bond Fund, of which amount $404,345 is for the
construction contract and $20,655 is for incidental and related expenses, all
applicable to Project No. 250 -70 -105.
SECTION 3. The necessity to authorize the execution of the aforesaid
contract and to appropriate the necessary funds, subject to concurrence from the
Texas Water Quality Board and the Environmental Protection Agency, in order that
the construction may be commenced at the earliest practicable date creates a
public emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally on the
date of its introduction but that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having declared

such emergency and necessity to exist, and having requested the suspension
of the Charter rule and that this ordinance take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

NANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
