AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH NUECES COUNTY TO ABATE THE PUBLIC HEALTH PROBLEMS
IN SAN JUAN SUBDIVISION, ALL AS MORE FULLY SET FORTH
IN THE CONTRACT, IN SUBSTANTIALLY THE FORM ATTACHED
HERETO AND MADE A PART HEREOF; MARRED EXHIBIT "A ";
AND DECLARING AN EMERGENCY.
WHEREAS, there exists an extreme public health hazard in the San
Juan area of Nueces County, which has resulted in disease and other nuisances
endangering the citizens of the City of Corpus Christi and Nueces County; and
WHEREAS, said health hazard and nuisance can beat be alleviated by
intergovernmental cooperation:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi be
and he is hereby authorized to enter into a contract with Nueces County to
abate the public health problems in the San Juan Subdivision, in Nueces County,
all as more fully set forth in the contract, a substantial copy of which is
attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to enter into the aforesaid contract at
the earliest practicable date in order that the existing health problems in
the San Juan Subdivision may be alleviated as soon as possible creates a public
emergency and an imperative public necessity requiring the suspension of the
Charter rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared such emergency
and necessity to exist, and having requested the suspension of the Charter rule
and that this ordinance take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED this the A day f October, 1975.

CONTRACT
The City of Corpus Christi, a home rule city, duly
authorized by the State of Texas, hereinafter called CITY, and
the County of Nueces, a political subdivision of the State of
Texas, hereinafter called COUNTY, do hereby enter into the
following contract and agreement:
W I T N E S S E T H:
WHEREAS, the County of Nueces has previously participated
with the City of Corpus Christi and the Federal Department of
Housing and Urban Development in the extension of sanitary sewer
line laterals to the San Juan Subdivision, and as an integral part
of such program Nueces County has heretofore provided financial
assistance in the amount of $28,300; and
WHEREAS, City and County are authorized to contract for
purposes promoting the common good by the Intergovernmental
Cooperation Act, and
WHEREAS, there exists an extreme public health hazard
in the San Juan area of Nueces County, which has resulted in
disease and other nuisances endangering the citizens of City
and County, and
WHEREAS, said health hazard and nuisance can best be
alleviated by intergovernmental cooperation, the County providing
funding, and the City abating said nuisance with said funding;
therefore, to these ends, the parties hereto do contract and
agree as follows:
1. County agrees to provide up to Twenty -five Thousand
Dollars ($25,000), to the City.
2. City agrees to use said funds exclusively to abate
the aforesaid nuisance currently existing in the San Juan area.
3. Any remaining or unused funds shall be returned to
the County by the City.

4. Both City and County agree that neither, in the
administration of this contract, will violate any law or
Constitutional edict of the State of Texas, particularly those
relating to the making of gifts or to the lending of credit,
and both agree it is their common purpose only to alleviate
a serious health hazard and nuisance, endangering both City
and County, currently existing in the San Juan area.
5. City shall not be expected to return to County
any monies collected or reimbursed as a result of expenditures
in connection with abatement of said nuisance.
6. Any future funds to be provided by County must be
by a separate contract or addendum to this contract, approved
by the City Council and the Commissioners' Court.

REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
