HomeMy WebLinkAbout12881 ORD - 10/29/1975• JKH:hb:10 /28/75:1st • AN ORDINANCE APPROPRIATING FROM THE REMAINING ASSETS OF THE NUECES COUNTY FRESH WATER SUPPLY DISTRICT NO. 1 AN AMOUNT OF $11,000 INTO FUND NO. 146, SEWER CONNECTIONS FUND, TO PAY THE COST OF SANITARY SEWER CONNECTIONS WHERE A HEALTH HAZARD EXISTS; AND DECLARING AN EMERGENCY. WHEREAS, on the 6th day of April, 1974, a majority of the qualified voters of the Nueces County Fresh Water Supply District No. 1 voted that said District should be dissolved; and WHEREAS, Senate Bill 283 as finally passed by the 64th Texas Legislative Session and signed by the Governor validated the election and declared the District dissolved; and WHEREAS, there exists an amount in excess of $11,000 in assets and anticipated receipts of said District: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an amount of $11,000 be appropriated from the remaining assets of the Nueces County Fresh Water Supply District No. 1 to Fund No. 146, Sewer Connections Fund, such fund to-be used to initially pay the cost of sanitary sewer connections, such connections to include the tap fee, front foot charge, and all pipe and other plumbing and instal- lation thereof within the property line, when a severe health hazard exists as determined by the City - County Health Department and the property owner is unable to in any other way pay for the connection. Payments to the fund will be made by the property owners, as provided in Section 38-55A of the City Code, as amended, until the full cost paid by the City for the connection and interest thereon has been paid to the fund. SECTION 2. Disbursement from this fund shall be made only to correct health hazards in the San Juan subdivision for the first 60 days following the date of passage of this ordinance and thereafter only for properties located within the boundaries of the former Nueces County Fresh Water Supply District No. I for the following 180 days. SECTION 3. The necessity for providing funds for payments for sewer connections where a health hazard exists creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from 71C and of er its passage, IT IS ACCORDINGLY SO ORDAINED, this th day of 1975.
