HomeMy WebLinkAbout12883 ORD - 10/29/1975RWC:jkh:10- 24 -75; 1st " AN ORDINANCE AMENDING ORDINANCE NO. 12164, PASSED ON JULY 10, 1974, KNOWN AS THE PLUMBING CODE OF THE CITY OF CORPUS CHRISTI, BY AMENDING CHAPTER 1 - ADMINISTRATION, SECTION 106.2 - SCHEDULE OF PERMIT FEES, SUBSECTION(f) SO AS TO WAIVE, FOR A PERIOD OF 90 DAYS FROM PASSAGE OF THIS ORDINANCE, THE REQUIREMENTS FOR ADDITIONAL FEES FOR PERMITS THAT REQUIRE INSPECTION OUTSIDE THE CITY LIMITS IN THOSE AREAS THAT HAVE BEEN DETERMINED TO POSE A PUBLIC HEALTH HAZARD WHICH CAN BE RELATED TO UNSAFE AND UNSANITARY PLUMBING SYSTEMS; PROVIDING FOR PUBLICA- TION; AND PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council has made a finding that there exists a public health hazard, and to expeditiously effect a remedy of the condi- tions contributing to the public health hazard, the City deems it necessary to temporarily suspend the requirement of the Plumbing Code that the $10 fee be charged for inspections outside the city limits: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12164, passed and approved by the City Council on July 10, 1974, known as the Plumbing Code of the City of Corpus Christi, be and the same is hereby amended by amending Chapter 1 - Administration, by amending subsection (f) of Section 106.2 to hereafter read as follows: "(f) Fees for permits which require inspection outside the city limits shall be increased by Ten ($10.00) Dollars. Fees for permits which require inspection outside the city limits for areas which have been determined to Involve a public health hazard which can be attributed to unsafe and unsanitary plumbing systems shall be temporarily exempted from the Ten ($10.00) Dollar additional fee for a period not to exceed ninety (90) days, the suspension of the inspection fee provided for by virtue of this amendment to expire 90 days after the passage of this ordinance." SECTION 2. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. 12883 SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. The necessity to enact the provisions hereinabove set forth at the earliest practicable date in order to effect a remedy of the conditions contributing to the public health hazard now existing creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .2f day of 1975.
