HomeMy WebLinkAbout12895 ORD - 11/05/1975• JKH:hb:11/5/75:1st • r AN ORDINANCE CLOSING THE UNOPENED PORTION OF BARRERA DRIVE BETWEEN PADRE ISLAND DRIVE AND LINDA VISTA STREET ABUTTING LOTS 1, 2, 3, 4, AND 5, BLOCK 8, AND LOTS 4, 5, 6, AND 7, BLOCK 5, COLONIA HIDALGO ADDITION, AND THE UNOPENED PORTION OF MOLINA DRIVE LOCATED BETWEEN PADRE ISLAND DRIVE AND LINDA VISTA STREET ABUTTING LOTS 1, 2, AND 3, BLOCK 5, AND LOTS 1 AND 2, BLOCK 2, COLONIA HIDALGO ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO RETENTION OF THE 50 -FOOT UNOPENED PORTION OF BARRERA DRIVE AS A UTILITY EASEMENT AND SUBJECT TO REPLATTING OF THE LOTS ABUTTING THE STREETS TO BE CLOSED INTO A SINGLE LOT; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of the unopened portion of Barrera Drive between Padre Island Drive and Linda Vista Street abutting Lots 1, 2, 3, 4, and 5, Block 8, and Lots 4, 59 6, and 7, Block 5, Colonia Hidalgo Addition, and the unopened portion of Molina Drive located between Padre Island Drive and Linda Vista Street abutting Lots 1, 2, and 3, Block 5, and Lots 1 and 2. Block 29 Colonic Hidalgo Addition, situated in Corpus Christi, Nueces County, Texas, was given by publication and by U. S. Mail to the last known addresses of the owners of property abutting said portion of said streets and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on October 29, 1975, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portion of unopened streets within the limits hereinafter described, for use as public streets, subject to certain conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the unopened portion of Barrera Drive between Padre Island Drive and Linda Vista Street abutting Lots 1, 2, 3, 4, and 5. Block 8, and Lots 4, 5, 6, and 7. Block 5, Colonia Hidalgo Addition, and the unopened portion of Molina Drive located between Padre Island Drive 12895 and Linda Vista Street abutting Lots 1, 2, and 3. Block 5, and Lots 1 and 2, Block 2, Colonia Hidalgo Addition, situated in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby closed for use as public streets and hereby revert to the abutting property owners, subject to the retention by the City of the 50 -foot unopened portion of Barters Drive as a utility easement, and further subject to replatting by the abutting property owners of the lots abutting the streets to be closed into a single lot. SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid streets creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the!5W- day of iInUFAtg� _ 1975.
