HomeMy WebLinkAbout12935 ORD - 12/17/1975JKH:hb:12 /16/75:lst • AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CONDEMN FEE TITLE TO CERTAIN PARCELS OR TRACTS OF LAND LOCATED IN NUECES COUNTY, TEXAS; DESCRIBING SAID PROPERTY, IDENTIFYING THE RECORD TITLE OWNERS AND CITING ANY OTHER PARTIES WHO MAY HAVE INTEREST OF RECORD, SAID CONDEMNATION BEING NECESSARY FOR THE ACQUISITION OF PARCELS N0. 103, 104 AND 304 FOR THE CORPUS CHRISTI BEACH PARK SITES, PROJECT NO. 291- 72 -12; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS AGAINST THE RECORD OWNERS, GREAT GULF CORPORATION, JACK ROBERT STILL AND WIFE, MARTHA L. STILL, AND RUTH M. JUERGENS, RESPECTIVELY, TO CARRY OUT THE INTENTIONS OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for and on behalf of the City of Corpus Christi, certain parcels or tracts of land described as follows: and Parcel No. 103 Lots One (1), Three (3), Five (5), Seven (7), Nine (9), and Eleven (11), Block Twenty -Three (23), Brooklyn or Rincon Addition, an addition to the City of Corpus Christi, Nueces County, Texas, as shown by map or plat thereof, recorded in Volume "A ", page 32, Map Records, Nueces County, Texas; Parcel No. 104 Lot Two (2), Block Twenty -Three (23), Brooklyn Addition, an addition to the City of Corpus Christi, Nueces County, Texas, according to plat recorded in Volume "A ", pages 30-32, Map Records, Nueces County, Texas. Parcel No. 304 Lots Nine (9) and Eleven (11), Block Three Hundred Eighty -Five (385), Brooklyn Addition to the City of Corpus Christi, Texas, as shown by the map or plat thereof, recorded in Volume "A ", page 32, Map Records, Nueces County, Texas. WHEREAS, the Corpus Christi Beach Park Sites Land Acquisition Project, Project No. 291- 72 -12, and other municipal purposes, requires the acquisition of the aforesaid parcels of land; and WHEREAS, record title to the aforesaid parcels appears to be in the following: Parcel No. 103, Great Gulf Corporation; Parcel No. 104, Jack Robert Still and wife, Martha L. Still; and Parcel No. 304, 12935 0 . � . I . .0 Ruth M. Juergen, Individually and as Independent Executrix of the Will and Estate of Harry E. Juergen, deceased; WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owners and claimants as to the price and value of said parcels, and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that said lots or parcels of land described be acquired through the exercise of the City's power of eminent domain for said public purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEMS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi, Nueces County, Texas, does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the aforesaid parcels of land and premises, excluding mineral interests, for use by the City for the Corpus Christi Beach Park Sites, Project No. 291- 72 -12, and for other municipal purposes, and to condemn the fee simple title to the aforesaid parcels or tracts of land, excluding mineral interests. SECTION 2. The City Attorney of the City of Corpus Christi is hereby authorized and directed to institute proceedings against the said properties, and against all person who appear to have an interest therein, and to proceed with said condemnation suits to final conclusion and to obtain possession and title to said properties for use in the Corpus Christi Beach Park Sites Project, Project No. 291- 72 -12, and for other municipal purposes. SECTION 3. The public importance and necessity for the City to gain immediate possession and title to the aforesaid parcels or tracts of land hereinabove described for the Corpus Christi Beach Park Sites, Project No. 291- 72 -12, and for other municipal purposes, as hereinabove described and provided, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings -2- of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the 17 day of 1975.
