AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH JOHN TUCKER, DEVELOPER, IN CONNECTION WITH
SANITARY SEWER SERVICES FOR LOTS 19 AND 20, LE TON
INDUSTRIAL CENTER, ALL AS MORE FOLLY SET FORTH IN THE
AGREEMENT, A SUBSTANTIAL COPY OF WHICH AGREEMENT IS
ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT
"A °; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with John Tucker, Developer, in connection with
sanitary sewer services for Lots 19 and 20, Lexington Industrial Center,
whereby the City will construct sanitary sewer facilities for Lexington
Industrial Center Subdivision and John Tucker will dedicate easements along
Lots 19 and 20 of Lexington Industrial Center and will pay the City $18,500
for his share of cost for said improvements, all as more fully set forth in
the agreement, a substantial copy of which is attached hereto and made a
part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize execution of the aforesaid
agreement so that construction of the said sanitary sewer facilities may be
commenced at the earliest practicable date creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that ,
no ordinance or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such emergency
and necessity to exist, and having requested the suspension of the Charter
rule and that this ordinance take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of
December, 1975.

AGREEMENT
THE STATE OF TEXAS X
COUNTY OF NUECES X
This agreement is entered into between the City of Corpus Christi,
Texas a Municipal Corporation and body politic, operating under the home
rule statutes of the State of Texas, hereinafter called "City ", and John
Tucker, hereinafter referred to as "Developer ".
NOW, THEREFORE, City and Developer agree as follows:
1. City will construct a sanitary sewer lift station at the south -
ease corner of Lexington Industrial Center Subdivision tract and a force main
and gravity sewer in O'Neil Street.
2. City agrees to maintain the lift station and other improvements
upon completion.
3. Developer agrees to dedicate to City the lift station site
situated in the southeast corner of said tract and shown in Exhibit "A '.
4. Developer also agrees to dedicate to City a 10' access easement
and provide all- weather access from the lift station site in said tract in a
northerly direction along the eastern edge of said tract to the public right-
of-way line at Padre Island Drive.
5. Developer also agrees to dedicate a 25' utility easement with
temporary construction easement running westerly along the southern edge of said
tract to the west border of said tract.
6. Developer further agrees to pay City the sum of $18,500 as his
share of cost for the improvements.
7. Developer, at his expense, shall provide sanitary sewer service
to Lots 19 and 20 of said subdivision, in accordance with the provisions of the
Platting Ordinance.

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NEf ESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT 13 INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
