HomeMy WebLinkAbout12967 ORD - 12/31/1975• jkh:12 -17 -75 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CONTRACT WITH THE EARLY CHILDHOOD DEVELOPMENT CENTER, DATED JUNE 1, 1975, WHICH CONTRACT WAS AUTHOR- IZED BY ORDINANCE NO. 12522, PASSED AND APPROVED BY THE CITY COUNCIL ON MARCH 12, 1975, SAID AMENDMENT TO PROVIDE FOR ACCEPTANCE BY THE SAID EARLY CHILDHOOD DEVELOPMENT CENTER OF ALL AMENDMENTS TO THE SAID CON- TRACT, AND IN PARTICULAR THE AMENDMENT DATED OCTOBER 1, 1975, AND TO FURTHER PROVIDE THAT SAID EARLY CHILDHOOD DEVELOPMENT CENTER SHALL INFORM ALL INDIVIDUALS OF THEIR RIGHT TO FAIR HEARINGS, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the contract with the Early Childhood Development Center, dated June 1, 1975, which contract was authorized by Ordinance No. 12522, passed and approved by the City Council on March 12, 1975, said amendment to provide for acceptance by the said Early Childhood Development Center of all amendments to the said contract, and in particular the amend- ment dated October 1, 1975, and to further provide that said Early Childhood Development Center shall inform all individuals of their right to fair hearings, all as more fully set forth in the amendment, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "Ag'. SECTION 2. The necessity to authorize execution of the amendment to the contract aforesaid creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its intro- duction and take effect and be in full force and effect from and after 1296`i CJ its passage, IT IS ACCORDINGLY SO ORDAINED, this the 3 1 sr day of December, 1975. ATTEST: , d' Secretary- AP VED: DAY OF DECEMBER, 1975: fhVW Aft44 City Attorney • THE CITY OF CORPUS CHRISTI, TEXAS • • AMENDMENTS TO CONTRACT FOR EARLY CHILDHOOD DEVELOPMENT CENTER THE STATE OF TEXAS p COUNTY OF NUECES WHEREAS, the City of Corpus Christi and the Early Childhood Development Center have entered into a contract under date of June 1, 1975; and WHEREAS, the parties desire to make amendments to said contract: NOW, THEREFORE, the parties agree that the following amendments be made to the current contract: 1. That Section 3. b. be amended to hereafter.read as follows: "b. Specifically agrees to accept and abide by all terms and condi- tions imposed upon subcontractors under the primary contract between the Department of Public Welfare and the City of Corpus Christi dated the 1st day of June, 1975 for the original contract, a copy of which is on file in the office of the.City Secretary of the City of Corpus Christi and incorpo- rated herein for all pertinent purposes, and all amendments thereof, particularly the amendment dated October 1, 1975." 2. That Section 3. k. be amended to hereafter read as follows: "k. Recognize the fair hearing process established by the Department of Public Welfare and abide by decisions rendered in such fair hearings. The Contractor shall inform all individuals of their right to such fair hearing." All other terms and conditions of the existing contract shall remain unchanged.
