LAWRENCE WEINER FOR A MUSICAL COMPOSITION TO COMMEMORATE THE BICENTENNIAL, SAID COMPOSITION TO BE USED FOR THE DEDICATION OF THE BICENTENNIAL AMPHITHEATER, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARRED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Dr. Lawrence Weiner for a musical composition to commemorate the Bicentennial, said composition to be used for the dedication of the Bicentennial Amphitheater, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to execute the aforesaid agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from a d after its passage, IT IS ACCORDINGLY SO ORDAINED, this the / y of , 1976. ATTEST: ty Secretary MAYO THE CITY OF CORPUS CHRISTI, TEXAS tP vED: DAY OF JANUARY, 1976 r A /L 4w City Attorney • • Ar_urx?ANnrr THE STATE OF TEXAS X COUNTY OF NUECES X WHEREAS, the City of Corpus Christi, a municipal corpora- tion and body politic, operating under the home rule statutes of the State of Texas, hereinafter called "City ", wishes to commission a musical piece for the Bicentennial celebration, and especially for the dedication of the Bicentennial Amphitheater; and at a date to be agreed upon between the parties; and WHEREAS, Dr. Lawrence Weiner, Associate Professor of Music at Texas A & I University at Corpus Christi, is recommended by the Bicenten- nial Commission to compose a work for performance by a symphonic band with narrator, and perhaps a choir: NOW, THEREFORE, the parties aforesaid agree as follows: 1. Dr. Lawrence Weiner shall compose the work to be played. The fee for the composition, if approved, would be $1,000.00. 2. Dr. Lawrence Weiner shall be responsible for copying and duplicating the scores and individual parts of the said composition in sufficient copies to meet the needs of the performing group. Such copies will be provided in sufficient time to accomodate the rehearsal schedule. Funds of $300.00, will be made available at the time such services are accomplished. 3. The performance will be by the municipal band under the direction of Richard R. Role. The performance will be considered as one for the City under theCMusic Performance Trust Fund Agreement .D There will be no additional fee for this performance. 4. Rehearsal of the composition will be by the band under the direction of Richard R. Kole. A fee of $500.00 is provided for rehearsal costs. 5. All publication, performance and copy rights to the composi- tion will remain with the composer, Dr. Weiner, except that through the Bicentennial year the composition may be played at any free event or over local radio or television stations without royalty fee. 6. Administration of the contract will be by the composer, Dr. Lawrence Weiner. He will coordinate the work of composing, transcribing, copying, rehearsing, and performing. • C7 7. During the creation of the composition a consulting committee will be utilized. The members will be Dr. Merton Johnson, Dean of Fine Arts, Del Mar College; Richard R. Kole, Del Mar College, Director of the Municipal Band; and Chester Malins, Chairman, Amphitheater Committee. 8. The Committee shall be charged with the responsibility of approving the composition. The composer's fee shall be paid only upon approval of the composition. In consideration of performing the new Bicentennial composition, especially for Corpus Christi for the dedication of the Bicentennial Amphitheater, the City of Corpus Christi agrees to pay the sum of One Thousand Eight Hundred and uo /100, ($1,800) as heretofore outlined, after presentation of bills at the conclusion of the performance. The City further agrees to provide the facilities for the performance. WITNESS OUR HANDS in duplicate originals, this the day of 1976.
