HomeMy WebLinkAbout12986 ORD - 01/14/1976jkh:1- 14 -76; 1st TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH WILBUR SMITH AND ASSOCIATES, INC., TO PROVIDE FOR THE CONSULTANTS TO UNDERTAKE ADDITIONAL TRANSIT STUDY BY EXPANDING THE TECHNICAL REPORT TO INCLUDE AN ANALYSIS AND RECOMMENDATION PERTAINING TO TRANSIT SERVICES FOR THE HANDICAPPED AND ELDERLY, AS MORE FULLY SET FORTH IN THE SAID SUPPLEMENTAL AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING OUT OF THE TRANSIT BOND FUND NO. 218 THE SUM OF $3,000 FOR THE AFORESAID SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute a supplemental agreement with Wilbur Smith and Associates, Inc., supplementing the agreement heretofore authorized by the City Council on March 19, 1975, by the passage of Ordinance No. 12538, said supplemental agreement to provide for the consultants to undertake additional transit study by expanding the technical report to include an analysis and recommendation pertaining to transit services for the handicapped and elderly, all as more fully set forth in the said supplemental agreement. a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. There is hereby appropriated out of the Transit Bond Fund No. 218 the sum of $3.000 for the aforesaid services. SECTION 3. The necessity to authorize the aforesaid supplemental agreement for the purposes set out hereinabove creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared, such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ay of January, 1976. ATTEST: Ci ecretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APP ED: DAY OF ARY, 1976: C.M S city ttorney 12986 S U P P L E M E N T A L A G R E E M E N T ------ - - - - -- --- - - - - -- This SUPPLEMENTAL AGREEMENT, made as of this day of 1975, by and between the City of Corpus Christi, 302 South Shoreline, Corpus Christi, Texas, hereinafter referred to as the "CITY," and Wilbur Smith and Associates, Inc., Consult- ing Engineers and Planners, 1535 West Loop South, Houston, Texas, hereinafter referred to as the "CONSULTANT." WHEREAS, the CITY and CONSULTANT entered into an AGREE- MENT on May 19,.197S, for the CONSULTANT to undertake the Transit Development Program as described in the Scope of Services within Article II of.said AGREEMENT for the CITY: and, WHEREAS, the CITY desires to expand the Scope of Services of said AGREEMENT to include the provision of additional pro- fessional services by the CONSULTANT in the performance of the Tasks identified herein: NOW, THEREFORE, it is agreed between parties that the original AGREEMENT shall be modified as follows: 1. ARTICLE II, SCOPE OF WORK, shall be amended to in- clude the following Task: 1.08 Review Existing Handicapped /Elderly Services - A review will be made of current technology and experi- ence related to specialized transit service for physi- cally handicapped persons, with a particular emphasis on vehicle types and required special equipment to accommo- date persons confined to wheelchairs. A definition will be established for handicapped and elderly persons, as well as types of vehicles and service in concert with the CITY. -1- Capital cost data, passenger capacities, internal vehicle designs, passenger safety requirements, and other pertinent vehicle characteristics will be identi- fied for consideration. 1.09 Estimate Handicapped and Elderly Travel Patterns - A maximum of five agencies which include local health organizations, public service organizations, and governmental agencies will be interviewed by the CONSULTANT in the Corpus Christi area. The purpose will be to quantify the order of magnitude and travel habits and characteristics of handicapped and elderly persons, and to estimate the potential users of special transit services. The CITY will prepare the list of eligible organi- zations to be interviewed,as well as agencies to receive a detailed survey questionnaire that presently provide or may potentially provide transit service to the handi- capped and elderly. The survey questionnaire prepared by the CONSULTANT and approved by the CITY will be dis- tributed and collected by the CONSULTANT. 2.12 Analyze Handicapped and Elderly Service Needs - Based on the equipment, service, and travel patterns, order of magnitude estimates will be made of the persons who may require door -to -door service over special rout- ings (includes para- transit) as compared with those who might utilize regular route bus service. 3.12 Develop System Alternatives - Candidate handi- capped and elderly person service systems (including para- transit) will be developed for subsequent evaluation. These alternatives wijl include vehicle types, operational 9 concepts, and methods of supervision and administration Also, the organizational structure within the CITY will be analyzed. 3.13 Evaluate Alternatives - The candidate systems identified in Task 3.12 will be evaluated on a compara- tive basis, and the system or system combination found to be most suitable for serving special service residents of.the Corpus Christi area will be reported. This evaluation will consider the level -of- service offered in terms of operating headways or response time to requests for service, service area comfort of vehicles, and possible combination use of vehicles for other service. Estimates will be made of capital and operating costs of the selected system. The impact of various fare structures will be estimated in terms.of ridership and revenue levels. Alternatives for integrating the handicapped and elderly program into the operations of city government will be evaluated. This will include the functional and economic impact the program will.have on the organi- zational structure of the CITY. Evaluation of the various'alternatives will include consultation with local officials to obtain policy guid- ance for developing the recommended system, prior to sub- mitting final recommendations for system implementation. 3.14 Develop Technical Report - A technical report will be prepared which outlines the work tasks performed, study analyses, and findings and recommendations. The report will include capital, operating cost estimates, and revenue estimates. An immediate - action 3 Program will be reported. 2. ARTICLE IV, TIME OF PERFORMANCE, shall.be amended to read in part: "a time interval of fourteen (14) months." 3. ARTICLE VII, COMPENSATION TO CONSULTANT, shall be amended as follows: "The CONSULTANT shall be reimbursed for direct and indirect costs incurred in the performance of the work defined in Article II, as amended, which are allowable under the provisions of sub -part 1 -15.2 of the Federal Procurement Re- gulations in.an amount not to exceed Fifty -Four Thousand Nine Hundred Sixteen and no /100 ($S4,916..00).Dollars including the CONSULTANT's fixed fee of Four Thousand Four Hundred Twenty - Four and no /100 ($4,424.00) Dollars. In accord with UMTA guidelines, the basis of the compensation for this study is indicated in Exhibit "A" and is attached as a part of this Agreement for information. This Exhibit is prepared on FAA Form 4400 -2 and estimates are given for direct labor, payroll burden, direct expenses -- including travel and subsis- tence, and professional services fixed fee. A "provisional" overhead rate of one hun- dred sixteen per cent (116 %) of direct salaries shall be utilized to estimate overhead costs during the performance of this contract. It is mutually agreed that the use of the provisional rate sets neither a minimum nor maximum to the final overhead costs to be paid the CONSULTANT. The final payroll burden percentage rate to be applied will be based on an audit of both direct labor charges and overhead charges conducted by the CONSULTANT's cognizant governmental audit agency or CITY audit appointee upon completion of this contract. 4. ARTICLE XXIII, MINORITY BUSINESS ENTERPRISE, shall be added to include the following paragraph to read: "In connection with the performance of this con- tract, the CONSULTANT will cooperate with the CITY in meeting its commitments and goals with regard to the maximum utilization of minority business enterprises."
