AND MRS. GEORGE PLOMARITY FOR $10,202.50, OF WHICH AMOUNT $10,000.00 IS FOR ACQUISITION AND $202,50 IS FOR INCIDENTAL COSTS RELATED TO CLOSING; PARCELS 28 THROUGH 32 FROM HARRY PLOMARITY, TRUSTEE, AND FRANCES PLOMARITY,PAPAJOHN, TRUSTEE, FOR $12,714.50, OF WHICH AMOUNT $12,500,00 IS FOR ACQUISITION AND $214.50 IS FOR INCIDENTAL COSTS RELATED TO CLOSING; PARCELS 33 THROUGH 35 FROM DR. AND MRS. A. J. ASHMORE AND DR. AND MRS. R. V. ST. JOHN FOR $7,687.50, OF WHICH AMOUNT $7,500.00 IS FOR ACQUISITION AND $187.50 IS FOR INCIDENTAL COSTS RELATED TO CLOSING; AND PARCEL 37 FROM DR. AND MRS. R. V. ST. JOHN FOR $2,664.50, OF WHICH $2,500,00 IS FOR ACQUISITION AND $164.50 IS FOR INCIDENTAL COSTS RELATED TO CLOSING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That there is hereby appropriated $79700 out of the No. 250 Sanitary Sewer Bond Fund for Project No. 250 -61 -25.5, Oso Sewer Plant Land Acquisition, to supplement funds previously appropriated by Ordinance No. 12770, passed and approved on August 27, 1975, for acquisi- tion, according to updated values, of Parcels 24 through 27 from Mr. and Mrs. George Plomarity for $10,202.50, of which amount $10,000 is for acquisi- tion and $202.50 is for incidental costs related to closing; Parcels 28 through 32 from Harry Plomarity, Trustee, and Frances Plomarity Papajohn, Trustee, for $12,714.50, of which emount.$12,500 is for acquisition and $214.50 is for incidental costs related to closing; Parcels 33 through 35 from Dr. and Mrs. A. J. Ashmore and Dr. and Mrs. R. V. St, John for $7,687.50, of which amount $7,500 is for acquisition and $187,50 is for incidental costs related to closing; and Parcel 37 from Dr. and Mrs. R. V. St. John for $2,664.50, of which $2,500 is for acquisition and $164.50 is for incidental costs related to closing, said parcels being more particularly described as follows: Parcels 24 - 27 Being a rectangular shaped tract of land comprised of Lots 1 thru 4. Block 3, EDGEWATER TERRACE, as shown by map of record in Volume 7, Pages 38 and 399 Map Records,_Nueces County, Texas, and the extension of said lots granted the defendent by judge- ment in Cause Number 83712-A. City of Corpus Christi, Texas , VS George Plomarity, District Court, Corpus Christi, Texas, and more particularly described by metes and bounds as follows: 13009 Beginning at a point in the South right -of -way line of Del Oso Road, said point being the Northeast corner of abovementioned Lot 1, Edgewater Terrace for the Northeast and beginning corner of the tract of land herein described; Thence S. 04° 52' 10" E., along the East boundary line of said Lot 1, and its extension granted by said judgement, passing the Northeast corner of an 80 foot wide drainage easement granted the City of Corpus Christi, Teams, by the aforementioned judgement at 300 feet, in all a distance of 380.0 feet to a point for the Southeast corner of this tract; Thence S. 850 07' 50" W., along the South line of the extension granted in said judgement of Lots 1 tbru 4, a distance of 400.0 feet to a point which is the Southwest corner of said Lot 4; Thence N. 040 52' 10" W., along the extension of Lot 4 granted in said judgement, passing the Northwest corner of abovementioned drainage easement at 80.0 feet, in all a distance of 380.0 feet along said extension and the West boundary line of said Lot 4 to a point on the South right- of-way line of said Del Oso Road. Thence N. 850 07' 50" E., along the South right -of -way line of said Del Oso Road a distance of 400.0 feet to the place of beginning and containing, 152,000 square feet or 3.489 acres more or less. Parcels 28 - 32 Being a rectangular shaped tract of land comprised of Lots 5 tbru 9, Block 3, EDCCEWWi4TER TERRACE, as shown by map of record in volume 7. SECTION 2. The necessity to appropriate the sums for the purposes outlined above creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of February, 1976.
