MOORE COMMUNITY SERVICE CENTER FOR USE OF SPACE AT THE CENTER BY THE HEALTH AND WELFARE DEPARTMENT FOR WELL -CHILD CONFERENCES, ALL AS MORE PARTICULARLY DESCRIBED IN THE LEASE AGREE- MENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A!'; AND DECLARING AN EMERGENCY, BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a five -year lease agreement with the Robert L. Moore Community Service Center for use of space at the Center by the Health and Welfare Deaprtment for well -child conferences, all as more fully described in the lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to authorize execution of the aforesaid agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect � from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the �d of , 1976. Moore Community Service Center at 3029 Sabinas Street has agreed to provide space for the principal use of the City - County Health and Welfare Department for its well -child conferences; and WHEREAS, the Center has also agreed to provide facilities for family planning conferences and immunization clinics conducted by the Health and Welfare Department; and WHEREAS, the Center must receive some rental income in order to offset its cost burdens to provide said facilities: NOW, THEREFORE, City and Robert L. Moore Community Service Center and Health and Welfare Department agree as follows: 1. The Robert L. Moore Community Service Center does hereby lease unto the City- County Health and Welfare Department for its use on a scheduled basis as mutually agreed between the parties, the well -child conference area presently being used by the department as of the date of this lease, for a period of five years beginning with the effective date of this lease. 2. The Center hereby reaffirms its dedication to providing facilities for the health of its citizens and those in the surrounding area. The consideration herein provided by the City is for space to be provided for City - County Health and Welfare well -child conferences only; this lease does not purport to contain any renewal options or guarantees to the Robert L. Moore Community Center for future payments of any kind. 3. The City hereby agrees to pay $2,500 for the five -year use of the space. Said $2,500 payment shall include all utilities and janitorial support necessary for the space provided. The $2,500 shall be due and payable on or before the last day of the first year of the lease. Should the Center for any reason be unable to provide the space for five years, the City shall be entitled to a reimbursement equal to the number of full months remaining in the lease divided by sixty and multiplied by $2,500. 4. A copy of this lease shall be filed with the Nueces County Clerk. 5. Either party may cancel this lease upon 30 days notice to the other party. In the event the Robert L. Moore Community Service Center exercises its right of cancellation herein, City shall be entitled to a refund of rental in accordance with paragraph 3 herein. 6. The effective date of this lease shall be the day after all parties hereto have executed this lease. ATTEST: City Secretary APPROVED: ROBERT L.
