JKH:vp:2 /4/76:lst • TEXAS: AN ORDINANCE AMENDING ORDINANCE NO. 4168, GENERALLY REFERRED TO AS THE "PLATTING ORDINANCE OF THE CITY OF CORPUS CHRISTI ", AS AMENDED, SO AS TO AMEND SECTION I- GENERAL, BY DESIG- NATING THE EXISTING PARAGRAPH AS PARAGRAPH A. JURISDICTION, AND ADDING TWO NEW SUBSECTIONS, TO BE DESIGNATED "B" AND "C ", SUBSECTION "B" TO PROVIDE THAT ANY REQUIREMENT IN THE EXISTING ORDINANCE IS NOT TO CIRCUMVENT ANY PUBLIC OR PRIVATE PROVISIONS THAT MAY BE MORE RESTRICTIVE, AND SUBSECTION "C" TO PROVIDE THAT THE PLANNING COMMISSION IS TO HAVE THE AUTHORITY TO REGULATE DESIGN, DEDICATIONS, IMRPROVEMENTS OR RESTRICTIVE USE OF LAND WHICH IS BEING SUBDIVIDED; AMENDING SECTION II - DEFINITIONS, BY DELETING THE THIRD SENTENCE IN SUBSECTION C. SUBDIVISION; AMENDING SECTION IV - DESIGN STANDARDS, SUBSECTIO E. LOTS, SO AS TO ESTABLISH A-ffnMu 3 FRONTAGE FOR =ALONG A PUBLIC STREET RIGHT OF WAY, BY AMENDING PARAGRAPH 2, (a), (b), AND (c), AS MORE FULLY SET FORTH HEREINAFTER; AMEND- ING SECTION VI - EXCEPTIONS, BY ADDING A NEW SUBSECTION, TO BE DESIGN E E. IVISIO N OF LAND FOR AGRICULTURAL OR PASTURE GRAZING PURPOSES; PROVIDING FOR SEVERANCE; AND PROVIDING R P B I I. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Ordinance No. 4168, generally known as the Platting Ordinance of the City of Corpus Christi, as amended, be and the same is hereby amended by amending Section I - General, by designating the existing para- graph as A. JURISDICTION, and adding two new subsections, to hereafter read as follows: "B. CONFLICT WITH PUBLIC AND PRIVATE PROVISIONS. 1. Public Provisions. This Platting Ordinance shall supplement and facilitate the enforcement of the provisions, standards, and specifications contained in the building and housing codes, Zoning Ordinance, Comprehensive Plan, Transportation Plan, and other official Plans of the City. Where any provision of this Platting Ordinance imposes restrictions different from those imposed by any other provision of any other City ordinance, rule or regulation or any other provision of law, whichever provisions are more restrictive or impose higher standards, shall control and be reflected in the plat. No plat showing a violation of a City Ordinance, rule or regulation shall be approved. 13036 0 0 2. Private Provisions. Where the provisions of this Platting Ordinance are more restrictive or impose higher standards or regulations than any private easement, convenant, agreement or restriction, then the requirements of this Ordinance shall govern. Where the provisions of any private easement, covenant, agreement, or restriction impose duties and obligations more restrictive or setforth higher standards-than the requirements of this Ordinance, then such private provisions shall be operative and supplemental to this Ordinance. C. CONDITIONS. The subdivision of land is a privilege conferred upon the developer by the laws of the State of Texas and through these platting regulations. It is the developer who is seeking to acquire the advantages of lot subdivision and upon him rests the duty of compliance with reasonable conditions laid down by the City Planning Commission for the design, dedication, improvement and restrictive. use of the land so as to provide for the physical and economical development of the area and the general welfare of the future lot owners in the subdivision and the community at large.) SECTION 2. That Ordinance No. 4168, as amended, be amended by amending Section II - DEFINITIONS by deleting the third sentence in Sub- section C. Subdivision, said Subsection C to hereafter read as follows: "C, SUBDIVISION, A subdivision is the division of any lot, tract, or parcel of land into two or more parts, lots or sites, for the purpose, whether immediate or future, of sale or division of ownership. This defini- tion also includes the resubdivision of land or lots which are a part of a previously recorded subdivision. An addition is a subdivision as is defined herein." SECTION 3. That Ordinance No. 4168, as amended, be amended by amending Section IV - DESIGN STANDARDS, Subsection E. LOTS, by amending paragraph 2 (a), (b) and (c), to hereafter read as follows: "2. Lot dimensions shall be as follows: -2- . 0 • (a) Residential lots where served by public sewer shall be not less than fifty (50) feet wide at the building line nor less than six thousand (6,000) square feet in area and shall abut a public street for a continuous distance of not less than thirty -five (35) feet. (b) Residential lots where not served by public sewer shall be not less than fifty (50) feet wide at the building line and shall not have less than thirty -five (35) feet of continuous public street frontage nor have an area less than that prescribed for health and sanitation purposes under Section V, B, 6 b. Such lots shall be laid out keeping in mind the possibility of resubdivision at such time as sanitary sewer service might become available. (c) Depth and width of properties reserved or laid out for church, club, or other semi - public u "se or for business or. Industrial purposes shall be adequate to provide for the off - street service and parking facilities required by the type of use and development contemplated, provided the lot abuts a public street for a continuous distance of not less than thirty - five (35) feet. SECTION 4. That Ordinance No. 4168, as amended, be amended by amending'Section -VI ' €XCEPTIAMS, by adding "a new sul-sectinrt," E. DIVISION OF LAND FOR AGRICULTURAL OR PASTURE GRAZING PURPOSES, to here- after read as follows: "E. DIVISION OF LAND FOR AGRICULTURAL OR PASTURE GRAZING PURPOSES. The division of land for agricultural or pasture grazing purposes, and where no building construction is involved, in parcels of 20 acres or more shall be exempted from the platting requirement of this ordinance, unless any such division of 20 acres or more includes the planning or development of a new street or access easement." -3- SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be held invalid by final judgment of a court of competent jurisdiction, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate. SECTION 6. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. • ATTEST: � All-c.
