AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO CONVEY TO MIGUEL
MERINO LOT 9, BLOCK 3, CASA BLANCA SUBDIVISION,
IN THE CITY OF CORPUS CHRISTI, NOECES COUNTY,
TEXAS, UPON PAYMENT OF THE CASE CONSIDERATION
OF $1,025 FOR SAID PARCEL, A COPY OF INSTRUMENT
CONVEYING THE SAME BEING ATTACHED HERETO AND
MADE A PART HEREOF, MARKED EXHIBIT "A "g AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to convey to Miguel Merino Lot 99 Bloch 3, Casa Blanca Subdivision, in the
City of Corpus Christi, Nueces County, Texas, upon payment of the cash
consideration of $1,025 for said parcel, a copy of instrument conveying the
same being attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to immediately authorize the execution
of a deed in order to facilitate the sale of the above described parcel of
land creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, having
requested the suspension of the Charter rule and that this ordinance take
effect and be in full force and effect form and af=it ssage, IT IS
ACCORDINGLY SO ORDAINED this the day of , 1976.

SPECIAL'WARRANTY'DEED
THE STATE OF TEXAS X
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES X
That the City of Corpus Christi, hereinafter called Grantor,
for and in consideration of the sum of One Thousand Twenty -Five Dollars
($1,025) to Grantor in hand paid by Miguel Merino, the receipt of which is
hereby acknowledged, and for which no lien is retained, either expressed
or implied, has this day GRANTED, SOLD AND CONVEYED, and by these presents
do GRANT, SELL AND CONVEY unto Miguel Merino, subject to the reservation
hereinafter made, of the County of Nueces, and State of Texas, all of the
following described real property in Nueces County, Texas, to -wit:
Lot 9, Block 3, Casa Blanca Subdivision in the
City of Corpus Christi, Nueces County, Texas.
TO HAVE AND TO HOLD the above described premises herein con-
veyed, together with all and singular the rights and appurtenances thereto
in anywise belonging to the said Miguel Merino, his heirs and assigns,
forever, and Grantor does hereby bind itself, its successors and assigns,
to warrant and forever defend all and singular the said premises unto the
said Grantee, his heirs and assigns, against every person whomsoever
lawfully claiming or to claim the same or any part thereof by, through, or
under Grantor.
Grantor does hereby impress such property with the following
restrictions, which restrictions shall be in addition to any valid and
existing restrictions of record affecting said property:
A. Grantee, his heirs and assigns shall, within three (3)
years of the date of this conveyance, construct or cause to have constructed
on the tract or parcel aforesaid a residential structure in accordance with
all applicable rules and regulations relating to construction within the
City. If such residential structure is not constructed within three years.
the parcel or tract aforesaid shall revert to the Grantor herein, and
Grantor will refund the purchase price to the then current owner.
B. These restrictions and covenants are hereby declared to
be covenants running with the land forever and shall be fully binding upon
all persona acquiring the above described property whether by descent,
devise, purchase or otherwise, and any person by the acceptance of title
to said property or any part thereof shall thereby agree and covenant to
abide by and fully perform the foregoing restrictions and covenants.
Invalidation of any one or any part of these restrictions or
covenants by judgment or court order shall in no wise affect any of the
other provisions or parts of provisions which shall remain in full force
and effect.
IN WITNESS WHEREOF, this instrument is executed on this the

appeared R. MARVIN TOWNSEND, City Manager of the City of Corpus Christi,
Texas, a municipal corporation, known to me to be the person and officer

me that he executed the same as the act and deed of said City of Corpus
Christi for the purposes and consideration therein expressed and in the
capacity therein stated.
