SMITH A TRACT OF LAND DESCRIBED AS LOT 3, BLOCK 1, ARCADIA SUBDIVISION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, UPON THE PAYMENT OF $15,000 CASH CONSIDERATION FOR SAID PARCEL, A SUBSTANTIAL COPY OF INSTRUMENT CONVEYING THE SAME BEING ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to convey to Mrs. Lilia C. Smith a tract of land described as Lot 3, Block 1, Arcadia Subdivision, also known as 1015 York Ave, in the City of Corpus Christi, Nueces County, Texas, upon the payment of the cash consideration of $15,000 for said parcel of land, a substantial copy of deed of conveyance being attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described parcel of land and return the same to the tax roll creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after • s passage, IT IS ACCORDINGLY SO ORDAINED this the �O day of 1976. Smith, the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or implied, has this day sold, and by these presents does GRANT, BARGAIN, SELL and CONVEY unto the said Mrs. Lilia C. Smith all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas, more particularly described as follows, to -wit: Lot 3, Block 1, Arcadia Subdivision, an addition to the City of Corpus Christi, Nueces County, Texas, as shown by map or plat thereof recorded in Volume 7, pages 9 and 10, Map Records of Nueces County, also known as 1014 York Avenue. TO HAVE AND TO HOLD the above described premises herein conveyed, together with all and singular the rights and appurtenances thereto in anywise belonging to the said Mrs. Lilia C. Smith, her heirs and assign, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend all and singular the said premises herein conveyed against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through, or under Grantor.
