HomeMy WebLinkAbout13154 ORD - 04/28/1976• JKH:hb:4 /28/76:lst AN ORDINANCE AUTHORIZING THE CITY MANAGER, SUBJECT TO THE EXECUTION OF AN AGREEMENT OF COOPERATION WITH THE WEST OSO INDE- PENDENT SCHOOL DISTRICT AND PAYMENT OF $20,000 TO THE CITY BY THE SCHOOL DISTRICT AS STIPULATED IN THE AGREE- MENT, AND SUBJECT TO APPROVAL OF A BUDGET AMENDMENT TO THE COMMUNITY DEVELOPMENT BLOCK GRANT 140. B -75 -MC 480502 BY THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, TO EXECUTE A CONTRACT WITH ASPHALT PAVING & CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE WEST OSO TENNIS COURT IMPROVEMENTS; APPROPRIATING A TOTAL OF $60,000, OF WHICH $59,770 IS FOR THE CONSTRUCTION CONTRACT AND $230 IS FOR INCIDENTAL AND RELATED EXPENSES; OF SAID TOTAL APPROPRIATION $35,000 IS OUT OF THE PARK BOND FOND, $34,770 BEING FOR THE CONSTRUCTION CONTRACT AND $230 FOR INCIDENTAL AND RELATED EXPENSES APPLICABLE TO PROJECT NO. 291- 72 -5.7, AND $25,000 IS OUT OF THE NO. 162 FEDERAL -STATE GRANTS FUND, ACTIVITY 4732, CODE 502, WHICH AMOUNT, BEING FOR THE CONSTRUCTION CONTRACT, IS TO BE TRANSFERRED TO THE NO. 291 PARR BOND FUND, PROJECT NO. 291- 72 -5.7; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, subject to the execution of an agreement of cooperation with the West Oso Independent School District and payment of $20,000 to the City by the School District as stipulated in the said agreement, and subject to approval of a Budget amendment to the Community Development Block Grant No. B- 75- NC480502 by the Department of Housing and Urban Development, be authorized to execute a contract with Asphalt Paving & Construction Company for construction of the West Oso Tennis Court Improvements, all as more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Asphalt Paving & Construction Company, opened on the 14th day of April, 1976, the said bid being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. That there is hereby appropriated the sum of $60,000, of which $59,770 is for the construction contract and $230 is for incidental and related expenses; of said total appropriation $35,000 is out of the Park Bond Fund, $34,770 being for the construction contract and $230 for incidental and related expenses applicable to Project No. 291- 72 -5.7, and $25,000 is out of the No. 162 Federal -State Grants Fund, Activity 4732, Code 502, which amount being for the construction contract, is to be transferred to the No. 291 Park Bond Fund for Project No. 291- 72 -5.7. 13154 • I SECTION 3. The necessity to execute the aforesaid contract and to appropriate the sums hereinabove set forth at the earliest practicable date in order that construction may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and efffpect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the jgy day of. 1976.
