HomeMy WebLinkAbout13161 ORD - 05/05/1976• JKH:hb:5/3/76:1et AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREE- MENT WITH INTERNATIONAL AERIAL MAPPING FOR AERIAL PHOTOGRAPHIC SERVICES OF THE METROPOLITAN PLANNING AREA AS IDENTIFIED IN THE UNIFIED WORK PROGRAM, A SUBSTANTIAL COPY OF SAID AGREEMENT BEING ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING AND REAPPROPRIATING $6,600 OUT OF THE NO. 162 FEDERAL - STATE GRANTS FUND, ACTIVITY 4754, CODE 301, FOR SAID SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with International Aerial Mapping for aerial photographic services of the Metropolitan Planning Area as identified in the Unified Work Program, a substantial copy of said agreement of which is attached hereto and made a part hereof. SECTION 2. That there, is hereby appropriated and reappropriated the sum of $6,600 out of the No. 162 Federal -State Grants Fund, Activity 4754, Code 301, for the aforesaid services. SECTION 3. The necessity to authorize execution of the afore- said agreement and to provide the necessary sums in order that the project aforesaid may proceed without delay creates a public emergency and an Imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the SEfday of May, 1976. BRUCE AYCOCK nCITY J=61 MAYO THE CITY OF CORPUS CHRISTI, TEXAS THE STATE OF TEXAS COUNTY OF NUECES 1( CONTRACT FOR PERSONAL SERVICES THIS AGREEMENT, entered into as of this day of , 1976, by and between International Aerial Mapping Company, herein called the "Consultant" and the City of Corpus Christi, Texas, as the designated Metropolitan Planning Organization for the Corpus Christi urbanized area, herein called the "City" (Exhibit "A" MPO Designation Agreement). WITNESS THAT: WHEREAS, the City desires to engage the Consultant to render certain technical or professional services hereafter described in connection with an undertaking which is to be entirely financed from Section 112 funds allocated to said undertaking as described in the "Corpus Christi Urbanized Area Unified Work Program for FY 1976 ", herein called "Unified Work Program ", and as authorized by the Section 112 contract between the State Department of Highways and Public Trans- portation and the City for reimbursement of funds to the City for completion of Unified Work Program tasks (Exhibit "B" Section 112 contract). NOW THEREFORE, the parties hereto do mutually agree as follows: I. Employment of Consultant. The City hereby agrees to engage the Con- sultant and the Consultant hereby agrees to perform in cooperation with the City the services hereinafter set forth in connection with the project of the City under the Unified Work Program. 2. Area Covered. The Consultant shall perform all the _necessary services provided under this contract under scope of services below within the Planning Area. 3, Scope of Services. The Consultant shall do, perform, and carry out in a satisfactory and proper manner, as determined by the City, the following major work element of the Unified Work Program: a. Provide aerial photography covering the City of Portland and Padre and Mustang Islands general described in the attached map marked Exhibit "A ". b. Furnish the City Film Positive Photo Atlas Sheets on a scale of 1" = 200', suitable for reproduction, or approximately 110 sheets. c. Furnish Cronapaque photo atlas sheets on scale of 1" = 200', or approximately 110 sheets. d. Provide new 1" = 900' aerial photography. • -2- • 4. Time of Performance. The services of the Consultant are to commence as soon as practicable after the execution of this Contract and shall be undertaken and completed in such sequence as to assure their expeditious completion in the light of the purposes of this Contract, but in any event, all of the services required hereunder shall be completed by July 1, 1976. 5. Compensation. The City agrees to pay the Consultant the total sum of Six Thousand Six Hundred Dollars ($6,600.00). 6. Method of Payment. The City shall pay the Consultant in full upon satisfactory completion of the project and delivery to the City of the specified photo atlas sheets, Cronapaque and film positives, and proper invoice by the Consultant. 7. Termination of Contract for Cause. If, through any cause, the Con- sultant shall fail to fulfill in timely and proper manner his obligations under this Contract, or if the Consultant shall violate any of the covenants, agreements; or stipulations of the Contract, the City shall thereupon have the right to termi- nate this Contract by giving written notice to the Consultant of such termination and specifying the effective date thereof, at least five (5) days before the effective date of such termination. 8. Equal Employment' Opportunity . The Consultant will not discriminate against any employee or applicant for employment because of race, color, religion, sex or national origin. The Consultant shall take affirmative action to ensure that applicants are employed and that employees are treated during employment, without regard to their race, color, religion, sex or national origin. Such actions shall include, but not be limited to, the following: employment, upgrading,' demotions or transfers, recruitment or recruitment advertising; layoffs or termina- tions; rates of pay or other forms of compensation; selection for training including apprenticeship;,and participation in recreational and educational activities. The Consultant agrees to post in conspicuous places available to employees and applicants for employment notices to be provided setting forth the provisions of this non- discrimination clause. The Consultant will in all solicitations or advertisements for employees placed by or on behalf of the Consultant, state that all qualified applicants will receive consideration for employment without regard to race, color, religion, sex or national origin. The Consultant will cause the foregoing provisions to be inserted in all subcontracts for any work covered by this contract so that such provisions will be binding upon each subcontractor provided that the foregoing .provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials. • C! 9. Aseigoability. The Consultant shall not assign any interest in this contract and shall not transfer any interest in the same (whether by assign- ment or novation), without the prior written consent of the City thereto: Pro- vided, however, that claims for money due or to become due to the Consultant from the City under this contract may be assigned to a bank, trust company or other financial institution without such approval. Notice of any such assignment or transfer shall be furnished promptly to the City. 10. Publication, Reproduction and Use of Material. No material produced in whole or in part under this contract shall be subject to copyright in the United States or in any other country. The City and member governments of the Corpus Christi Urban Transportation Study Area shall have unrestricted authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data, or other materials prepared under this contract.
