FRANK SMITH A TRACT OF LAND DESCRIBED AS LOT 25, BLOCK 11, CHAMBFRIAIN SUBDIVISION, AND THE CITY'S INTEREST IN THE WEST FRACTIONAL PORTION OF LOT 24, BLOCK 11, CHAMBERLAIN SUBDIVISION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEAS, FOR A CASE CONSIDERATION OF $3,000 FOR SAID PARCELS AND CONVEYANCE OF LOT 25 BY SPECIAL WARRANTY DEED AND THE CITY'S INTEREST IN LOT 24 BY QUITCLAIM DEED, COPIES OF WHICH INSTRUMENTS ARE ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBITS "A" AND "B "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be authorized to convey to T. Frank Smith a tract of land described as Lot 25, Block 11, Chamberlain Subdivision, and the City's interest in the West Fractional Portion of Lot 24, Block 11, Chamberlain Subdivision to the City of Corpus Christi, Nueces County, Texas, upon payment of a cash consideration of $3,000, all as more fully set forth in the Special Warranty Deed and in the Quitclaim Deed, copies of which instruments are attached hereto and made a part hereof, marked Exhibits "A" and "B ". SECTION 2. The necessity to immediately authorize the execution • of the aforesaid deeds in order to facilitate the conveyance of the aforesaid parcels or tracts of land creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the low of May, 1976. Frank Smith, the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or implied, has this day sold, and by these presents does GRANT, BARGAIN, SELL and CONVEY unto the said T. Frank Smith all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas, more particularly described as follows, to -wit: Lot 25, Block 11, Chamberlain Subdivision in the City of Corpus Christi, Nueces County, Texas. TO HAVE AND TO HOLD the above described premises herein conveyed, together with all and singular the rights and appurtenances thereto in any- wise belonging to the said T. Frank Smith, his heirs, successors, and assigns, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend all and singular the said premises herein conveyed against every person whomsoever lawfully claiming or to claim the same or any pert thereof by, through, or under Grantor. TO HAVE AND TO HOLD all of City of Corpus Christi's right, title and interest in and to the above described property and premises unto the said Grantee, its heirs, successors and assigns forever, so that neither City of Corpus Christi nor its legal representatives, successors or assigns sha71 at any time hereafter have, claim or demand any right or title to the afore- said property, premises or appurtenances or any part thereof.
