HomeMy WebLinkAbout13176 ORD - 05/12/1976® JKH:hb:5/12/76:1et • AN ORDINANCE CLOSING AND ABANDONING THE EXISTING 5 -700T UTILITY EASEMENT LOCATED IN LOT 9, BLOCK 1, FALLINS RIVERSIDE SUBDIVISION, A SUBDIVISION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO A REPLAT OF THE PROPERTY BY THE OWNERS; PRO- VIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a certain 5 -foot utility easement in Lot 9, Block 1. Fallins Riverside Subdivision, as shown by plat recorded in Volume 39, pages 3B and 39, Map Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 5 -foot utility easement in Lot 9, Block 1, Fallins Riverside Subdivision, in the City of Corpus Christi, Nueces County, Texas, as shown on the plat thereof recorded in Volume 39, pages 38 and 39, of the Map Records of Nueces County, and more particularly described hereinafter, be and the same is hereby closed for public use and every municipal purpose, subject to replatting of the property by the owners thereof, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas: Being a 5 -foot wide strip of land for utility ease- ment out of Lot 9, Block 1 of Fallins Riverside Subdivision, Block 1, Lots 1,2,3,7,8, and 9 as recorded in Volume 39, Pages 38 and 39, Map Records of Nueces County, Texas and being more particularly described by metes and bounds as follows: Beginning at a point in the most southerly south- east boundary line of said Lot 9 from whence the most southerly southeast corner of Lot 9, bears S. 36° 10' 50" W. 5 feet; Thence N. 53° 49' 10" W. a distance of 5 feet to a point; Thence N. 36° 10' 50" E, along a line that is 5 feet west of and parallel to the most southerly southeast line of said Lot 9, a distance of 128.20 feet to a point; MILHUMMED JUN x.61980 =76 rI Thence N. 53° 45' 20" W., a distance of 5 feet to the most northerly southeast corner of said Lot 9; Thence S. 36° 10' 50" W, along the most southerly southeast line of said Lot 9, a distance of 128.20 feet to the place of beginning. SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent juris- diction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1day of , 1976.
