HomeMy WebLinkAbout13184 ORD - 05/19/1976r JKEI:bb:5 /19/76:lst AN ORDINANCE ABANDONING THE WEST 2 -1/2 FEET OF A 7 -1/2 FOOT UTILITY EASEMENT ON THE EAST BOUNDARY OF LOT 10, BLOCK 11, FLYWAY UNIT 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY PLAT RECORDED IN VOLUME 41, PAGES 78 AND 79, NAP RECORDS OF NUECES COUNTY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 7 -1/2 foot utility easement on the east boundary of Lot 10, Block 11, Flyway Unit 1, as shown by plat recorded in Volume 41, pages 78 and 79, Map Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Taxes; and WHEREAS, it has been determined that it is feasible and ad- vantageous to the City of Corpus Christi to abandon the west 2 -1/2 feet of the said utility easement to the owner of the abutting property: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the west 2 -1/2 feet of a 7 -1/2 foot utility easement on the east boundary of Lot 10, Block 11, Flyway Unit 1, as shown by plat recorded in Volume 41, pages 78 and 79, Map Records of Nueces County, be and the same is hereby closed and abandoned for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portion of the described utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the klunutkmo JUN 16 1980 �3�84 Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the _day of ...M 1976.
