HomeMy WebLinkAbout13193 ORD - 05/26/1976JKH:vp:5 /19/76:2d, AN ORDINANCE APPROVING A NEW RATE SCHEDULE FOR THE FURNISHING OF COMMUNITY ANTENNA TELEVISION SERVICES WITHIN THE CITY OF CORPUS CHRISTI BY ATHENA CABLEVISION OF CORPUS CHRISTI, INC.; PROVIDING THAT THIS ORDINANCE SHALL NOT RESTRICT THE POWER OF THE CITY TO RE- DETERMINE RATES; PROVIDING SEVERABILITY; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION. WHEREAS, Athena Cablevision of Corpus Christi, Inc. (hereinafter f called Athena), has requested approval by the City Council of new rates for services to be rendered under any renewal of its franchise; and WHEREAS, a public hearing on the request for increased rates was held by the City Council on May 5, 1976; and WHEREAS, at such hearing the City Council received and considered comments and data concerning Athena's investment in the system, Athena's general financial condition, the cost of rendering services, and other matters relevant to a determination of proper rates: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council approves and Athena is hereby authorized to charge for its services not in excess of the following rates, to become effective no sooner than upon final passage and publication of this ordinance: Classification of Services: (Monthly Services Rate) Residential: Rate Single $ 7.50 Additional outlet, each 2.50 F.M., each 2.50 Commercial: Single 7.50 Additional outlet, each 3.00 F.M., each 3.00 Other: Public Schools, Colleges No Charge and Nonprofit Hospitals MICROFILMED. INSTALLATION RATES Classification of Charges: JUN :L6 1980 Residential: ase§ Outer 15.00 Additional outlets, each 12.50 Transfer within building 10.00 Transfer from one location to another 12.50 F.M. outlet without TV installment 15.00 Reconnect, each outlet 10.00 131-93 Commercial. Motel, Hotel, Apt. House Hospitals (except nonprofit), etc. Actual costs plus 10% Exceptions: Company may, in its discretion, allow a discount to subscribers for prompt or prepayment of charges and may establish special rates from time to time for promotional purposes; provided, however, that such special rates shall not exceed those set out herein and are otherwise in compliance with the City ordinance. The above rates may be placed into effect on any date after the effective date of this ordinance or be placed into effect in increments. Such incremental actions shall be placed into effect in a uniform manner without discrimination as to classification or geographic location of customers. SECTION 2. This ordinance is not intended to restrict or waive the right of City to re- determine rates at any time and require the furnish- ing to the City of such information as the City may deem necessary for the purpose of considering any such re- determination of rates. Nor does this ordinance intend to restrict the right of Athena to request approval of rate changes during the term of the renewed franchise. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
